BODY:
Whereas, A petition was presented to the Common Council of the City of Milwaukee by Milwaukee Metropolitan Sewerage District and others on the 3rd day of June, 1997 for the vacation of South Harbor Drive from East Scott Street northerly to its terminus in the 14th Aldermanic District; now, therefore be it
 
Resolved, By the Common Council of the City of Milwaukee that the fee of $218.00 otherwise required to be paid to the City Treasurer prior to receiving the petition for said vacation be and hereby is waived, and the City Treasurer be and hereby is authorized to waive said fee pursuant to Ordinance 234 of the City of Milwaukee, passed July 11, 1961; and be it
 
Further Resolved, By the Common Council of the City of Milwaukee, that said petition be and the same is hereby granted and that the following described portion of said street to-wit:
 
All that part of South Harbor Drive, as presently open, in the Southwest 1/4 of Section 33, Township 7 North, Range 22 East, described as follows: Commencing at the southwest corner of said 1/4 Section; thence North 89 degrees, 56 minutes, 29 seconds East, along the south line of said 1/4 Section, 2450.28 feet to a point; thence North 20 degrees, 13 minutes, 01 second West 1381.29 feet to a point; thence North 54 degrees 32 minutes, 09 seconds West 35.18 feet to the point of beginning of the land to be described; thence North 80 degrees 10 minutes 51 seconds East, along the northerly line of South Harbor Drive, 59.99 feet to a point; thence South 09 degrees 49 minutes 09 seconds East, along the easterly line of South Harbor Drive, 125.30 feet to a point; thence continuing, along said easterly line, South 17 degrees 06 minutes 23 seconds East 283.54 feet to a point of curve; thence continuing, along said easterly line, Southeasterly 110.46 feet along the arc of said curve whose radius is 100.00 feet with its center lying to the northeast having a central angle of 63 degrees 17 minutes 21 seconds and whose chord bears South 48 degrees 45 minutes 03.5 seconds East 104.93 feet to a point of tangency; thence South 80 degrees 23 minutes 50 seconds East, along the northerly line of East Scott Street, 96.81 feet to a point on a curve; thence Southwesterly 156.82 feet along the arc of said curve whose radius is 75.00 feet with its center lying to the southeast having a central angle of 119 degrees 48 minutes 08 seconds and whose chord bears South 39 degrees 42 minutes 06 seconds West 129.77 feet to a point of tangency; thence South 20 degrees 11 minutes 58 seconds East 49.97 feet to a point on a curve, said point being on the westerly line of South Harbor Drive; thence Northwesterly 95.92 feet along said westerly line and the arc of said curve whose radius is 395.00 feet with its center lying to the southwest having a central angle of 13 degrees 54 minutes 50 seconds and whose chord bears North 27 degrees 09 minutes 23 seconds West 95.69 feet to a point of compound curve; thence continuing, along said westerly line, Northwesterly 27.00 feet along the arc of said curve whose radius is 95.00 feet with its center lying to the southwest having a central angle of 16 degrees 17 minutes 02 seconds and whose chord bears North 42 degrees 15 minutes 19 seconds West 26.91 feet to a point of tangency; thence continuing, along said westerly line, North 50 degrees 23 minutes 50 seconds West 60.28 feet to a point of curve; thence continuing, along said westerly line, Northwesterly 58.10 feet along the arc of said curve whose radius is 100.00 feet with its center lying to the northeast having a central angle of 33 degrees 17 minutes 27 seconds and whose chord bears North 33 degrees 45 minutes 07 seconds West 57.29 feet to a point of tangency; thence continuing, along said westerly line, North 17 degrees 06 minutes 23 seconds West 316.14 feet to a point; thence continuing, along said westerly line, North 09 degrees 49 minutes 09 seconds West 12.92 feet to a point of curve; thence continuing, along said westerly line, Northwesterly 62.53 feet along the arc of said curve whose radius is 100.00 feet with its center lying to the southwest having a central angle of 35 degrees 49 minutes 44 seconds and whose chord bears North 27 degrees 44 minutes 01 second West 61.52 feet to a point of compound curve; thence continuing, along said westerly line, Northwesterly 8.96 feet along the arc of said curve whose radius is 35.00 feet with its center lying to the southwest having a central angle of 14 degrees 39 minutes 46 seconds and whose chord bears North 52 degrees 58 minutes 46 seconds West 8.93 feet to a point; thence continuing, along said westerly line, North 01 degree 48 minutes 06 seconds West 50.49 feet to the point of beginning.
 
be and the same hereby is vacated for the reason that the same is of no public utility and the public interest requires the same to be vacated; and be it
 
Further Resolved, That as provided by Section 80.32(4) of the Wisconsin Statutes, such vacation shall not terminate the easements and rights incidental thereto acquired by or belonging to any county, town, village or city, or to any utility or person in any underground structures, improvements or services, as enumerated or otherwise existing in said street and in said description of land above described, but such easements and rights and all rights of entrance, maintenance, construction and repair with reference thereto shall continue as if such street had not been vacated; and be it
 
Further Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works be and he is hereby directed, within two months from the date of the adoption of this resolution, to view the aforesaid portion of said street vacated, and assess the benefits and damages accruing or arising from said vacation, and to make his report of his assessment of such benefits and damages to the Common Council of the City of Milwaukee, as required by law.
