Title
Resolution removing a deed restriction from two former tax-deed, vacant lots formerly known as 233-37 East Garfield Avenue and 2143 North Hubbard Street, in the 6th Aldermanic District. (DCD-Real Estate)
Analysis
This resolution will remove a deed restriction imposed by the City of Milwaukee that prohibits division of land and construction of a principal building.
Body
Whereas, Pursuant to Common Council File No. 82-917-a adopted January 24, 1984, the City of Milwaukee conveyed to Sidney Perssion by Quit Claim Deed dated February 14, 1984, two tax-deed, vacant lots at 233-37 East Garfield Avenue and 2143 North Hubbard Street that joined his property at 227-29 East Garfield Avenue; and
 
Whereas, The deed of conveyance contained restrictions that "the property herein conveyed shall be joined with the grantee's adjoining property so as to create a single parcel to be used as a unit; that said combined parcel shall not be divided without the approval of the Common Council of the City of Milwaukee; and that the land herein conveyed shall be used as open space and no principal building may be erected thereon"; and
 
Whereas, Removal of the deed restriction is required to allow the current owners, P&F Enterprises, LLP, to separate the parcel into two sites to build a new duplex on the newly-created vacant lot while creating a separate parcel for the existing duplex; and
 
Whereas, The Department of City Development recommends release of the deed restriction contingent upon department approval of site and building plans for the new structure; and
 
Whereas, The Redevelopment Authority of the City of Milwaukee will be reimbursed for any administrative expenses incurred in removing this deed restriction; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the proper City officials are authorized and directed to execute the necessary legal documents to remove the restriction contained in the deed dated February 14, 1984, to allow for creation of two separate sites and for residential construction on the newly-created site.
