This substitute resolution authorizes the Community Block Grant Administration to submit a final statement of community development objectives for disaster relief and projected use of funds to the Department of Housing and Urban Development for award of $1,455,474. In addition, this resolution designates the Mayor as the authorized representative for the CDBG Disaster Recovery Initiative, approves the certifications required by the Department of Housing and Urban Development, and authorizes the Community Block Grant Administration to execute and implement the project designated in the final statement. This resolution further authorizes the appropriate City officials to accept the CDBG Disaster Relief Grant, the Office of the City Comptroller to establish the necessary accounts, and the appropriate agency to implement the approved project.

BODY:

Whereas, Southeastern Wisconsin counties experienced flooding on June 21, 1997 due to severe storms; and

 

Whereas, A Presidential Disaster Declaration was issued in Southeastern Wisconsin counties which made funding available for mitigation activities through the Hazard Mitigation Grant Program; and

 

Whereas, The City of Milwaukee ("City") submitted an application for the grant program to the State of Wisconsin Division of Emergency Management for floodproofing homes as authorized by Common Council File No. 971325; and

 

Whereas, The City was notified by the Secretary of the Department of Housing and Urban Development ("HUD") on February 12, 1998 that it would receive an award of $1,455,474 for disaster relief due to severe summer flooding in June of 1997; and

 

Whereas, The Community Block Grant Administration has prepared a statement of community development objectives for disaster relief and projected use of funds "application" in accordance with File Numbers 74-92-e and 74-92-5t; and

 

Whereas, This Common Council File will authorize the submission of a final statement of community development objectives for disaster relief and projected use of Community Development Block Grant ("CDBG") funds available under Title I of the Housing and Community Development Act of 1974 (as amended) and under Public Law 103-211 for disaster recovery assistance; and

 

Whereas, It has been determined that operation of this CDBG grant program from June 1, 1998 through December 31, 1999 would cost approximately $1,455,474 of which all dollars would be provided by the Grantor; and

 

Whereas, The local share of this grant program, for a portion of the City's indirect costs, can be provided from the following sources:

 

In-Kind City Share: $-0-

 

Out-of-Pocket City Share: $-0-

 

Local, Non-City Share: $-0-

 

; and

 

Whereas, It has been determined that the benefits to the City from this grant program appear to exceed the City's share of costs and other obligations to be incurred under this program; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee that the Community Block Grant Administration is authorized to submit to the United States Department of Housing and Urban Development a final statement of community development objectives for disaster relief and projected use of funds available under Title I of the Housing and Community Development Act of 1974 (as amended) and under Public Law 103-211 for disaster recovery assistance, attached to this Common Council File as well as any other related documentation required by the Department of Housing and Urban Development; and, be it

 

Further Resolved, That the Mayor of the City of Milwaukee is designated as the authorized representative of the City in connection with all matters relating to the CDBG Disaster Recovery Initiative; and, be it

 

Further Resolved, That the City assures and certifies that it will comply with regulations, policies, guidelines and requirements with respect to the acceptance and use of the CDBG Disaster Relief Program funds as specifically delineated in the Certifications attached to this Common Council File; and, be it

 

Further Resolved, That the appropriate City officials are authorized to accept such a grant without further Common Council approval unless:

 

1. The purpose of such grant program is significantly changed.

 

2. The amount of the Out-of-Pocket City Share increases from that specified above.

 

3. The ratio of the Out-of-Pocket City Share to Grantor Share increases from that specified above;

 

and, be it

 

Further Resolved, That the City Comptroller is directed to reserve (encumber), in the parent accounts of the 1998 Special Revenue Account - Grant and Aids Projects the following amounts for the CDBG Disaster Relief Grant:

 

Account No. - 15-010-0100 Account - Grantor's Share Amount - $1,455,474

 

Account No. 15-010-0101 Account - In-Kind City Share Amount - $-0-

 

Total - $1,455,474

 

; and, be it

 

Further Resolved, That the Common Council directs that the 1998 Positions Ordinance, File No. 970831, be amended as follows:

 

Department Name: Department of City Development Decision Unit: 2 under Financial Service and Marketing Grant: Disaster Relief Grant

 

Add:

 

1 position of Housing Program Specialist, Pay Grade 3

 

Amend footnote (c) as follows:

 

To expire unless 1997 Disaster Relief Flood Grant, available from the United States Department of Housing and Urban Development, is extended. Positions shall be deemed to be authorized only as reflected in the Grant Agreement as approved by the Grantor Agency; and, be it

 

Further Resolved, That the above-mentioned position and a current position of a Housing Rehabilitation Specialist-Senior under the same Decision Unit be designated as 100 percent funded from this Disaster Relief Grant; and, be it

 

Further Resolved, That the above-mentioned two positions be entitled to receive mileage reimbursement; and, be it

 

Further Resolved, That upon execution of a Grant Agreement, the City Comptroller is authorized and directed to:

 

1. Create within the Special Revenue Fund - CDBG Disaster Relief Grant the necessary revenue and expenditure accounts for this grant program.

 

2. Transfer to these accounts, consistent with City accounting policies, the amounts required under the Grant Agreement - but not to exceed a 10 percent increase in the amounts reserved for the Grantor's Share and In-Kind City Share.

 

3. Transfer the corresponding offsetting estimated revenue.

 

4. Transfer to the 1998 parent accounts of the Special Revenue Accounts - Grant and Aid Projects the appropriations in accordance with Grant Ordinance No. 940843 adopted in 1994.

 

5. Appropriate and charge central service costs in accordance with an approved cost allocation plan as required under Office of Management Budget Circular A-87;

 

and, be it

 

Further Resolved, That the grant funds received from HUD be deposited in accordance with the applicable Federal guidelines and the procedures established by the City Comptroller; and, be it

 

Further Resolved, That the Program Director of the Community Block Grant Administration is authorized and directed to enter into the contracts and agreements required in the program project detailed in the Final Statement of Community Development Objectives for Disaster Relief and Projected Use of Funds in accordance with City Procedures and Grant Guidelines; and, be it

 

Further Resolved, That the agency responsible for the administration of the Disaster Relief Program is authorized as follows:

 

Neighborhood Improvement Development Corporation ("NIDC") - $1,382,474; and, be it

 

Further Resolved, That these funds will be used for the following activities:

 

Grants to eligible homeowners as described in the plan which is attached to this Common Council File.

 

$50,000 to examine the feasibility of acquiring environmental easements in the floodplains of the Menomonee, Milwaukee and Kinnickinnic Rivers; and, be it

 

Further Resolved, That the Management Agreement between the City and NIDC which was approved by Common Council File No. 971303 is amended to include this new program activity; and, be it

 

Further Resolved, That $73,000 be allocated to the budget of the Community Block Grant Administration for contractual obligations; and, be it

 

Further Resolved, That NIDC is required to submit budget and activity reports in amounts and according to any conditions approved by the Common Council and the Mayor in conformance with Grant Ordinance No. 940843 to the Community Block Grant Administration and the City Comptroller for their review and approval; and, be it

 

Further Resolved, That payments for CDBG Disaster Relief costs incurred shall be paid in accordance with approved CDBG reimbursed policy based on the approval by the Community Block Grant Administration and City Comptroller of a Budget Forecast (CDA-50); and, be it

 

Further Resolved, That the authorization for the program listed in this resolution is subject to availability of CDBG Disaster Relief and the release of funds for this purpose by HUD; and, be it

 

Further Resolved, That the Community Block Grant Administration is authorized to execute and implement the City's CDBG Disaster Relief program in accordance with the final statement of community development objectives for disaster relief and projected use of funds.
