Substitute resolution appropriating funds from the Common Council Contingent Fund to the Outside Counsel/Expert Witness Fund Special Purpose Account for the purposes of retaining outside counsel or an expert witness.

Analysis
This substitute resolution appropriates $110,000 from the Common Council Contingent Fund to the Outside Counsel/Expert Witness Fund Special Purpose Account for the purposes of providing outside counsel to the City of Milwaukee in MPA, et al. v. City of Milwaukee, et al., Circuit Court Case No. 97-CV-007996, and retaining outside legal counsel relating to the creation of a new pension system.
BODY:
Whereas, The City of Milwaukee is a defendant in the case of MPA, et al. v. City of Milwaukee, et al., Case No. 97-CV-007996; and
Whereas, The City Attorney is unable to defend the City in the action that has been brought and the City has entered into a contract with the firm of Reinhart, Boerner, Van Deuren, Norris & Rieselbach, S.C. to provide the City with representation in the above-referenced action; and
Whereas, Such representation has been previously approved in Common Council File No. 970387 and appropriations have been made in the amount of $60,000 for the purpose of such representation in Common Council File No. 970387 and Common Council File No. 971609; and
Whereas, Billings by Reinhart, Boerner, Van Deuren, Norris & Rieselbach, S.C. in Case No. 97-CV-007996, through May, total $121,417.88, and are in excess of the appropriation by $61,417.88; and
Whereas, The Common Council in Common Council File No. 971781 appropriated $39,000 from the City Attorney's Outside Counsel/Expert Witness Fund Special Purposes Account for the purpose of funding an amendment to the contract between the City and the law firm of Reinhart, Boerner, Van Deuren, Norris & Rieselbach, S.C. authorizing the firm to act as legal consultant and retain an actuarial consultant to establish a new pension plan for City employees; and
Whereas, Billings by Reinhart, Boerner, Van Deuren, Norris & Rieselbach, S.C. for outside counsel for the creation of a new pension plan through May of 1998, total $40,592.84 and are in excess of the appropriation by $1,592.84; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that the sum of $100,000 be appropriated from the Contingent Fund to the Outside Counsel/Expert Witness Fund Special Purpose Account, Account No. 01-023-8001 and to the City Attorney's Office in Account No. 01-023-8002 for the purposes of providing legal counsel to the City of Milwaukee under the terms of the contract between the City and the law firm of Reinhart, Boerner, Van Deuren, Norris & Rieselbach, S.C. for a legal defense in MPA, et al. v. City of Milwaukee, et al., Case No. 97-CV-007996, and $10,000 for purposes of development of a new pension plan. Such amounts to be expended upon the presentation of invoices for services to the Office of the City Attorney and meeting with the approval of the City Attorney.
