Title
Resolution accepting an easement from Bank One allowing the City of Milwaukee to construct, own and maintain a new segment of riverwalk to be located adjacent to the Bank One parking garage on the east side of the Milwaukee River immediately north of East Clybourn Street. (DPW)
Analysis
This resolution authorizes acceptance from Bank One of an easement in the Milwaukee River adjacent to Bank One's parking garage.  The easement will allow the City to construct, own and maintain a new section of riverwalk that will link the downtown riverwalk system with the riverwalk system being constructed in the Historic Third Ward.
Body
Whereas, The City of Milwaukee has entered into agreements with the Historic Third Ward (BID #2) via Common Council File Number 040011 and with the Milwaukee Riverwalk District (BID #15) via Common Council file number 040010) providing for  construction of a new segment of riverwalk that will link the existing downtown riverwalk system with the riverwalk system now under construction in the Historic Third Ward; and

Whereas, The City has secured a $250,000 grant from the State of Wisconsin to partially fund this new riverwalk segment; and

Whereas, The City, BID #2 and BID #15 will share the remaining cost of the riverwalk; and

Whereas, The new section of riverwalk will be constructed adjacent to the Bank One parking garage on the east side of the Milwaukee River immediately north of East Clybourn Street; and

Whereas, Bank One already owns and maintains a riverwalk along its parking garage and is reluctant to own and be responsible for maintenance of a second riverwalk in the same block; and

Whereas, The City already owns and maintains several riverwalk segments including the Mason Street plaza, sections of riverwalk along the west side of the river in the block between Wells and Kilbourn, and the Highland pedestrian bridge and associated plazas; and

Whereas, City ownership of the new section to be located adjacent to Bank One's parking garage appears to be the most expedient way to attain Bank One's cooperation in the project; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the proper City officials are authorized to work with the Bank to prepare, execute, and record an easement from the bank to the City allowing the City to construct, own and maintain a new riverwalk adjacent to the Bank One parking garage that will link the Historic Third Ward Riverwalk to the Downtown Riverwalk.
