Body

WHEREAS, the Housing Authority of the City of Milwaukee (HACM) on behalf of Westlawn Renaissance IV LLC (WRIV LLC) awarded a contract to Travaux Inc. (Travaux) to serve as Construction Manager at Risk (as Contractor) [i.e. as Constructor] for Westlawn Renaissance IV in an amount not to exceed $13,950,000.00, per Resolution No. 13164 adopted on July 8, 2020; and

 

WHEREAS, WRIV LLC and Travaux did not agree upon a Guaranteed Maximum Price pursuant to the Construction Manager at Risk contract; and

 

WHEREAS, WRIV LLC wishes to continue an association with Travaux for the Westlawn Renaissance IV project by engaging Travaux as Construction Manager as Advisor; and

 

WHEREAS, the HACM and Travaux executed a Co-Developer and Representation Agreement for Westlawn Gardens Development that encompasses representative services that a Construction Manager as Advisor would typically provide; and

 

WHEREAS, the HACM may extend the Co-Developer and Representation Agreement for Westlawn Gardens Development with Travaux to WRIV LLC, of which the HACM is the Developer and the Managing Member through its wholly owned Limited Liability Company, Westlawn Renaissance IV Development LLC; and

 

WHEREAS, WRIV LLC and Travaux have negotiated a Construction Manager as Advisor contract for Westlawn Renaissance IV for agreed upon services in an amount not to exceed $467,018.00; now, therefore, be it

 

RESOLVED, by the HACM on behalf of WRVI LLC that it approves rescinding the contract award to Travaux to be the Construction Manager at Risk (as Contractor) [i.e. as Constructor] for Westlawn Renaissance IV in an amount not to exceed $13,950,000.00; and be it

 

FURTHER RESOLVED, by the HACM on behalf of WRVI LLC that it approves entering into a contract with Travaux to be the Construction Manager as Advisor for Westlawn Renaissance IV in an amount not to exceed

$467,018.00; and, be it

 

FURTHER RESOLVED, that the proper officers of the HACM are hereby authorized and directed to properly execute said contract for and on behalf of WRIV LLC; and, be it

 

FURTHER RESOLVED, that if any extensions of the time of performance and change orders are needed, the Chairman or Secretary-Executive Director may approve such request without any further action of the HACM; and, be it

 

FURTHER RESOLVED, that all acts previously performed, relative to this matter, by the Commissioners and the Secretary-Executive Director of the HACM, be and hereby are approved, ratified, and confirmed in all respects.
