Title
Substitute resolution reserving $18,777 in the 2002 Common Council Contingent Fund for the purpose of providing funds for the purchase and installation of "no smoking" signs throughout city buildings and city-owned and leased vehicles, and the purchase and placement of cigarette disposal containers outside of city buildings.
Analysis
Common Council File Number 901402, which was passed on June 25, 2002, prohibits smoking in enclosed, indoor areas of city buildings and in city-owned and leased vehicles.
 
This substitute resolution authorizes and directs the Commissioner of Public Works to post "no smoking" signs at appropriate locations throughout city buildings and city-owned and leased vehicles, and to place cigarette disposal containers at appropriate locations outside of city buildings.
 
In addition, this substitute resolution reserves $18,777 in the 2002 Common Council Contingent Fund for the Department of Public Works - Operations Division - Building and Fleet Services for the purpose of providing funds for the purchase and installation of "no smoking" signs throughout city buildings and city-owned and leased vehicles, and the purchase and placement of cigarette disposal containers outside of city buildings.

Whereas, Common Council File Number 901402, which was passed on June 25, 2002, provides that no person may carry a lighted cigar, cigarette, pipe or any other lighted smoking equipment in any enclosed, indoor area of a city building, including any hallway, waiting area, rest room, cafeteria, meeting room, lobby or reception area or private, enclosed office of any employe or elected official or in any city-owned or leased vehicle; and
 
Whereas, Common Council File Number 901402 also provides that persons in charge of city buildings or areas where smoking is prohibited shall post or cause to be posted in a clear and conspicuous manner in all entrances and areas of city buildings "no smoking" signs or international "no smoking" symbols consisting of a pictorial representation of a burning cigarette enclosed in a red circle with a red bar across it; and
 
Whereas, Section 101.123, Wis. Stats., which is commonly known as the "Clean Indoor Air Act," and hereinafter referred to as the Act, defines "person in charge" to be the person who ultimately controls, governs or directs the activities within a place where smoking is regulated under the Act regardless of the person's status as owner or lessee; and
 
Whereas, The Act directs the Commissioner of Public Works or his designated agent to post or cause to be posted "no smoking" signs at appropriate locations throughout city buildings and city-owned and leased vehicles; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works is authorized and directed to purchase and install "no smoking" signs throughout city buildings and city-owned and leased vehicles, and purchase and place cigarette disposal containers outside of city buildings; and, be it
 
Further Resolved, That the City Comptroller is authorized and directed to reserve $18,777 in the 2002 Common Council Contingent Fund (0001-9990-C001-006300-2002) and to transfer on an as-needed basis up to $18,777 from these reserved funds to a special account within the Department of Public Works- Operations Division - Building and Fleet for the purpose of providing funds for the purchase and installation of "no smoking" signs throughout city buildings and city-owned and leased vehicles, and the purchase and placement of cigarette disposal containers outside of city buildings; and, be it
 
Further Resolved, That the City Comptroller is authorized and directed to establish all funds and accounting procedures necessary to fulfil the intent of this resolution.
