Title

Resolution authorizing the Commissioner of Public Works to execute a change order to a Milwaukee Metropolitan Sewerage District Green Solutions grant funding agreement for the installation of bioswales within North Jefferson Street between East Wells Avenue and East Erie Street in the 4th Aldermanic District.

Analysis

This resolution authorizes the Commissioner of Public Works to execute a change order to a Milwaukee Metropolitan Sewerage District Green Solutions grant funding agreement for the installation of bioswales in North Jefferson Street between East Wells Avenue and East Erie Street in the 4th Aldermanic District. The change order allows the City of Milwaukee to construct the bioswales without any City share. 

Body

Whereas, Common Council File No. 250384 authorized the City to enter into a Green Solution Funding Agreement (G98005P181) with the Milwaukee Metropolitan Sewerage District (MMSD) to accept and fund a grant with a maximum reimbursement amount of $225,000 in grantor funds for the installation of bioswales in North Jefferson Street between East Wells Avenue and East Erie Street in the City of Milwaukee; and

 

Whereas, Common Council File Nos. 250267 and 250404 authorized additional City Share funding for anticipated construction costs in excess of $225,000 based on estimates developed during design; and

 

Whereas, The total estimated construction cost of said bioswales on North Jefferson Street based on bid results for the construction contract is approximately $280,000 and can be better funded in its entirety by grantor share; and

 

Whereas, The MMSD has prepared a change order amending the previously mentioned funding agreement to provide an additional $74,000 in grantor funds, allowing a maximum reimbursement amount of $299,000; now, therefore, be it

 

Resolved, That the Commissioner of Public Works is authorized to accept and execute a change order to the Green Solutions Funding agreement in accordance with Milwaukee Code of Ordinances 304-81, and to execute the change order in the form submitted to this file, or in substantial conformity thereto; and, be it

 

Further Resolved, That upon approval of the change order to said Agreement, the City Comptroller is authorized to modify the existing Project/Grant Chartfield Value for this project and transfer to this account the amount required under the agreement and City accounting policy, but not to exceed a ten percent increase of the total amounts reserved for the grantor’s share and local share or $5,000, whichever is greater, as follows:

;and, be it

 

Further Resolved, That these funds are appropriated to the Department of Public Works, which is authorized to expend from the amount budgeted for specific purposes as indicated in the grant budgets and incur costs consistent with the award date; and, be it

 

Further Resolved, That the Commissioner of Public Works shall have the authority to authorize transfers within the project budget so long as the amount expended for any purpose shall not exceed the amount authorized by the budget by 10% and such transfers are in accordance with grantor regulations; and, be it

 

Further Resolved, That the Commissioner of Public Works, on behalf of the City of Milwaukee, is authorized to enter into subcontracts (and leases) as detailed in the project budget and in accordance with City purchasing procedures and grant and aid guidelines for awarding such contracts.
