Title

Resolution approving a Fifth Amendment to Lease Agreement with T-Mobile Central LLC relating to extending the term of the lease at the Hawley Road Water Tower at 5701 West McKinley Avenue.

Analysis

This resolution approves a Fifth Amendment to Lease Agreement with T-Mobile Central LLC for the installation and operation of communication and ancillary equipment at the Hawley Road Water Tower at 5701 West McKinley Avenue.

Body

Whereas, Pursuant to Common Council File Number 000715 adopted on September 22, 2000, the City entered into a lease agreement with Voicestream Wireless for the placement of personal communication services antennas at the Hawley Road Water Tower at 1235 North 57th Street.

 

Whereas, The Common Council File Number 050899 adopted on November 15, 2005, approved a First Amendment to Lease Agreement that addressed rent; and

 

Whereas, The Common Council File Number 110462 adopted on November 2, 2011, approved a Second Amendment to Lease Agreement extending the lease agreement; and

 

Whereas, The Common Council File Number 120716 adopted on February 27, 2013, approved a Third Amendment to Lease Agreement allowing T-Mobile to upgrade its facilities; and

 

Whereas, The Common Council File Number 170336 adopted on June 20, 2017, approved a Fourth Amendment to Lease Agreement allowing T-Mobile to modify its equipment; and

 

Whereas, The Milwaukee Water Works and the City Attorney’s Office negotiated a Fifth Amendment to Lease Agreement with T-Mobile Central LLC relating to extending the term of the lease; and

 

Whereas, Under this amendment one extension term of five years and two option terms of five years each will extend the term of the lease; and

 

Whereas, The fifth lease amendment offers a fair market value to the City, protects other City interests, and is acceptable to all City participants; now, therefore, be it;

 

Resolved, By the Common Council of the City of Milwaukee, That the Common Council approves a Fifth Amendment to Lease Agreement with T-Mobile Central LLC at the Hawley Road Water Tower at 5701 West McKinley Avenue, a copy of which is attached to this file, and authorizes the proper City officials to enter into said agreement on behalf of the City of Milwaukee.
