TITLE

Resolution authorizing the issuance of a permit to Gorman & Company Incorporated, allowing occupancy of a portion of the public alley in the block bounded by West Clarke Street, West Wright Street, North 28^th Street, and North 29^th Street.

ANALYSIS

This resolution authorizes City officials to issue an occupancy permit to Gorman & Company Incorporated allowing the company to occupy the full width of a 10-foot wide public alley in the block bounded by West Clarke Street, West Wright Street, North 28^th Street and North 29^th Street. The affected section of alley abuts the north side of the site of the Dr. Wesley L. Scott Senior Living Community, which is located at 2800 West Wright Street. The company would occupy the alley in conjunction with its work on the community center. The expanded center will cover almost the entire site. Therefore, Gorman & Company has requested permission to occupy the alley abutting the site.

BODY

Whereas, Gorman & Company is acting as the general contractor for the Dr. Wesley L. Scott Senior Living Community project; and

Whereas, There is no space available on the project site for construction staging activities including materials storage and removal of construction debris; and

Whereas, The site located at 2800 West Wright Street is bounded on its north side by a public alley; and

Whereas, Gorman & Company has requested permission to occupy the public alley that abuts the site for construction-related activities during the course of the expansion project; and

Whereas, Occupancy of this alley is expected to last for approximately one year beginning in January 2006; and

Whereas, Those properties on the north side of the affected alley do not take access directly from the affected alley; and

Whereas, The Commissioner of Public Works may approve temporary occupancy of up to one third of public rights-of-way while temporary use beyond that point must be approved by the Common Council; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the appropriate City officials are hereby authorized to issue a permit to Gorman & Company allowing occupancy of the full width of the public alley located adjacent to the north side of the Dr. Wesley L. Scott project site; and, be it

Further Resolved, That the occupancy permit for this alley shall be good for a period of up to one year from the date the permit is issued.
