Title
Substitute resolution to vacate the right-turn bypass at the Northeast corner of North 12th Street and West Wisconsin Avenue, in the 4th Aldermanic District.
Analysis
This substitute resolution vacates the above right-turn bypass in accordance with vacation proceedings under power granted to the City of Milwaukee by Section 66.297(1), Wisconsin Statutes, and Section 81-308-28, Milwaukee Code of Ordinances, and permits the Redevelopment Authority to convey said land according to the terms of the Land Disposition Report. This vacation was requested by Marquette University since the right-turn bypass was eliminated as part of the Wisconsin Avenue street improvements.
Body
Whereas, It is proposed that the right-turn bypass at the Northeast corner of North 12th Street and West Wisconsin Avenue be vacated pursuant to the provisions of Section 62.73, Wisconsin Statutes; and
 
Whereas, Said vacation has been reviewed in accordance with Sections 81-116-1 and 308-28, Milwaukee Code of Ordinances; and
 
Whereas, Upon vacation, the land will revert to the Redevelopment Authority of the City of Milwaukee ("Authority"); and
 
Whereas, The Authority previously conveyed to Marquette University the adjoining property at 1100 West Wisconsin Avenue that is now being developed with the Al McGuire Center and the vacated area is needed for the project; and
 
Whereas, The Authority expects to conduct a Public Hearing on May 15, 2003, on the proposed disposition as required by Wisconsin Statutes and submits herewith a Land Disposition Report, a copy of which is attached to this Common Council File; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that said right-turn bypass, as indicated by Exhibit A and bound and described by:
 
That part of West Wisconsin Avenue in the Northwest 1/4 of Section 29, Township 7 North, Range 22 East, described as follows:
 
Commencing at the point of intersection of the west line of North 11th Street and the present northerly line of West Wisconsin Avenue; thence Southwesterly and Northwesterly, along said present northerly line, to its point of intersection with the east line of North 12th Street; thence Southerly, along the southerly extension of said east line, to a point lying 75 feet North of, as measured normal to, the south line of said 1/4 Section; thence Northeasterly to a point in the southerly extension of the west line of North 11th Street, said point lying 82 feet North of, as measured normal to, the south line of said 1/4 Section; thence Northerly, along said southerly extension, to the point of commencement, is vacated; and, be it
 
Further Resolved, That no additional costs or work will be necessary as a result of this vacation since the right-turn bypass has been eliminated as part of the Marquette University beautification project; and, be it
 
Further Resolved, That as provided by Section 80.32(4), Wisconsin Statutes, said vacation shall not terminate the easements and rights incidental thereto acquired by or belonging to any county, town, village or city, or to any utility or person in any underground structures, improvements or services, as enumerated or otherwise existing in said description of land above described, both easements and rights and all rights of entrance, maintenance, construction and repair with reference thereto shall continue as if said right-turn bypass had not been vacated; and, be it
 
Further Resolved, That upon vacation and reversion to the Authority, the Authority may convey the land to Marquette University according to the terms of the Land Disposition Report contingent on the Authority conducting the requisite public hearing and approving said Land Disposition Report.
