Substitute motion supporting introduction and passage of state legislation relating to appeals of zoning regulations.

This motion declares the Common Council's support and passage of state legislation permitting cities of the first class, with respect to appeals of zoning regulations, the following options:
 
1. Specify the composition of a board of appeals by ordinance upon action of the common council.
 
2. Establish a zoning hearing examiner to exercise all or part of the duties currently performed by a board of appeals. Establishment of such a position and delineation of duties together with those of a board of appeals shall be by ordinance upon action of the common council.
BODY:
Whereas, The Common Council views itself as an co-partner with the executive branch of city government in the sharing of responsibility and accountability in the delivery of city services; and
 
Whereas, The Common Council finds that within the structure of city government, sufficient checks and balances must be maintained for purposes of protecting the public interest; and
 
Whereas, State legislation, with respect to prescribing local government structure and procedures, often has the effect of restricting local options, and does not sufficiently consider the need to maintain checks and balances, and the interests of citizens and their local government; and
 
Whereas, With respect to appeals of zoning regulations, current state legislation is too restrictive in not permitting the City of Milwaukee - the legislative and executive branches - the option of self-determination, the authority to legislate and prescribe regulations for purposes of responding to citizen concerns and to also create a balanced sharing of responsibility and accountability between these branches; now, therefore,
 
It is moved, By the Common Council of the City of Milwaukee, that the Council supports introduction and passage of state legislation permitting cities of the first class, with respect to appeals of zoning regulations, the following options:
 
1. Specify the composition of a board of appeals by ordinance upon action of the common council.
 
2. Establish a zoning hearing examiner all or part of the duties currently performed by a board of appeals. Establishment of such a position and delineation of duties together with those of a board of appeals shall be by ordinance upon action of the common council.
