Title

Resolution approving the execution of a nonexclusive pedestrian and bicycle easement agreement with Milwaukee Storage Solutions LLC regarding access to the Beerline Trail, in the 6th Aldermanic District.

Analysis

This resolution approves the execution of a nonexclusive pedestrian and bicycle easement agreement between the City of Milwaukee, a Wisconsin municipal corporation, and Milwaukee Storage Solutions LLC, a Wisconsin limited liability company, regarding access to the Beerline Trail, in the 6th Aldermanic District.

Body

Whereas, Milwaukee Storage Solutions LLC (the “Grantor”) owns the property located at 3745-3775 North Richards Street, Milwaukee, Wisconsin 53212 (the “Property”); and

 

Whereas, The Property resides adjacent to the Beerline Trail, a project launched in 2013 with the purpose of serving as a “spine” to advance efforts to unify the Harambee and Riverwest neighborhoods it connects; and

 

Whereas, The Property could serve as a public access point from East Vienna Avenue to the Beerline Trail; and

 

Whereas, The City of Milwaukee (“City”) has negotiated and agreed to the attached terms with Grantor for an easement of ingress and egress on a non-exclusive basis in common with Grantor over and across a portion of land on the Property for public access to and from the Beerline Trail; and

 

Whereas, The Office of the City Attorney has reviewed the proposed Easement Agreement, a copy of which is attached hereto; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the nonexclusive pedestrian and bicycle easement agreement is hereby approved; and, be it

 

Further Resolved, That the proper City officials are hereby authorized to execute the nonexclusive pedestrian and bicycle easement agreement in substantial conformity to the agreement submitted alongside this file, and take other reasonable steps needed to execute the nonexclusive pedestrian and bicycle easement agreement on behalf of the City of Milwaukee.
