Substitute resolution authorizing and directing the Commissioner of Public Works to execute a document titled "State/Municipal Agreement for a Highway Improvement Project" with the Wisconsin Department of Transportation for programming and construction of South Whitnall Avenue from South Clement Avenue to Old South Brust Avenue with Federal/State Aid.

This resolution authorizes and directs the Commissioner of Public Works to execute a project agreement with the Wisconsin Department of Transportation for the programming and construction of South Whitnall Avenue from South Clement Avenue to Old South Brust Avenue with Federal/State Aid. Portions of this project lie in Milwaukee and St. Francis. The agreement provides 80 percent Federal/State funds. The total project cost is estimated to be $670,500 of which the local share is estimated to be approximately $134,100. The City's share of preliminary engineering costs for the proposed improvements are estimated to be $9,000 (or 50% of the local share). This resolution also authorizes and directs the City Comptroller to transfer funds and establish subaccount for the preliminary engineering work. This resolution also authorizes the Commissioner of Public Works to negotiate an agreement with the City of St. Francis for their participation in the South Whitnall Avenue project.
BODY:
Whereas, Preliminary approval has been requested and received for the Wisconsin Department of Transportation (WISDOT) along with a Project Agreement to be executed by the City of Milwaukee for the programming and construction of South Whitnall Avenue from South Clement Avenue to Old South Brust Avenue with Federal/State Aid; and
Whereas, Portions of South Whitnall Avenue lie within the City of St. Francis and an agreement with regard to the sharing of costs for the improvement will be required with the City of St. Francis; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that the Commissioner of Public Works (CPW) is hereby authorized and directed to execute an agreement for the programming and construction of South Whitnall Avenue from South Clement Avenue to Old South Brust Avenue with Federal/State Aid, copies of which are attached to Common Council Resolution File Number 990109, and are incorporated in this resolution by reference as though set forth in full; and, be it
Further Resolved, That the CPW is hereby authorized and directed to undertake or engage a consultant to undertake preliminary engineering for the improvement of the aforementioned project and to reimburse the WISDOT for preliminary engineering costs they incur for the improvement; and, be it
Further Resolved, That the CPW is hereby authorized and directed to enter into an agreement with the WISDOT pertaining to the cost participation for the installation and/or modification of traffic control facilities in conjunction with the improvements of the aforementioned project, if necessary; and, be it
Further Resolved, That the CPW is hereby authorized and directed to install the traffic control facilities necessary in conjunction with the aforementioned project following the execution of the traffic control agreement the cost of which will be included in future resolutions, if necessary; and, be it
Further Resolved, That the City Comptroller is hereby authorized to create within the Capital Improvement Fund, Grant and Aid Projects, the necessary Project/Grant Chartfield Values for preliminary engineering for the project (Expenditure) and transfer to any of these accounts the amount required under the grant agreement and City Accounting Policy but not to exceed a 10 percent increase of the total amounts reserved for the grantor's share and local share or $5,000, whichever is greater, as follows:

Further Resolved, That the CPW is hereby authorized and directed to negotiate and execute an agreement for the sharing of costs of the improvement of South Whitnall Avenue with the City of St. Francis, said agreement covering their share of preliminary engineering, plan preparation and construction costs for the portions of the improvement which are under their jurisdiction; and, be it
Further Resolved, That the City Engineer is hereby authorized and directed to approve and make periodic payments to the WISDOT upon receipt of invoices for the City's share of costs of the above projects.
