Analysis
This resolution approves an Out-of-Program Agreement between Heritage Development of Wisconsin, a developer, and the City of Milwaukee. The Agreement outlines how public improvements needed to support Phase I of a proposed 148 lot single-family home subdivision to be located easterly of North Granville Road at West Donna Drive will be designed, funded and built. In sum, upon subsequent approval of the Commissioner of Public Works, the developer will design and the City will review public improvement plans. The developer will manage construction of the improvements. And the City will inspect the work. All of this will be done at the developer's expense.

Whereas, Heritage Development of Wisconsin, a developer, desires to enter into an Out-of-Program Agreement with the City of Milwaukee regarding the design, construction and funding of public improvements to serve phase I of a 148 lot single-family home subdivision to be located easterly of North Granville Road at West Donna Drive; and
Whereas, The Out-of-Program Agreement for this development is attached to the file; and
Whereas, Under the terms of the Agreement, the proposed public improvements would be designed and installed at no cost to the City of Milwaukee; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that the Out-of-Program Agreement attached to this file is hereby approved and the proper City officers are hereby authorized to execute said Agreement on behalf of the City of Milwaukee; and, be it
Further Resolved, That all City Departments are authorized to perform engineering, surveys, plan preparation, and to determine the estimated cost thereof; and, be it
Further Resolved, That The Commissioner of Public Works is authorized to accept funds from the developer to undertake all necessary design engineering or, in the alternative, to permit the developer to prepare the necessary engineering plans which would be subject to review and approval by the Commissioner; and, be it
Further Resolved, That the Commissioner is further authorized to make minor, non-substantive changes to the Out-of-Program Agreement prior to its execution.
