Title

Resolution accepting a quit claim deed to dedicate public right-of-way for North Cape Street, East Dock Street, East Ship Street and East Vine Street in the area between North Commerce Street and the Milwaukee River and between East Pleasant Street and the North Holton Street Viaduct, in the 6th Aldermanic District.

Analysis

This resolution permits the City of Milwaukee to accept a quit claim deed to dedicate land for public right-of-way.

Body

Whereas, Certified Survey Map No. 6882 for the Trostel Square development along North Commerce Street and the Milwaukee River identified Public Highway Easements for interior streets to permit public access to the units and to the Riverwalk; and

 

Whereas, The Department of Public Works has requested that these easements be formally dedicated as public right-of-way and has prepared a map of the proposed dedications, a copy of which is attached to this Common Council File; and

 

Whereas, The property owner has agreed to quit claim the land to the City of Milwaukee (“City”) for dedication as public right-of-way for no monetary consideration; and

 

Whereas, The legal descriptions of the property to be acquired are as follows:

 

North Cape Street: That part of Parcel 4 of Certified Survey Map No. 6882, in the Northwest 1/4 and the Southwest 1/4 of Section 21, Township 7 North, Range 22 East, described as follows: Commencing at the most northerly corner of Parcel 2 of said certified survey map; thence South 49°19’41” West, along the northwesterly line of Parcel 2 aforesaid, 121.52 feet to the most westerly corner of Parcel 2; thence North 40°40’19” West, along the northwesterly extension of the southwesterly line of Parcel 2 aforesaid, 54.00 feet to a point; thence North 49°19’41” East, parallel to the northwesterly line of Parcel 2 aforesaid, 121.52 feet to a point in the northwesterly extension of the northeasterly line of Parcel 2; thence South 40°40’19” East, along said northwesterly extension, 54.00 feet to the point of commencement.

 

East Dock Street: That part of Parcel 4 of Certified Survey Map No. 6882, in the Northwest 1/4 and the Southwest 1/4 of Section 21, Township 7 North, Range 22 East, described as follows: Commencing at the most northerly corner of Parcel 4; thence Southwesterly 43.14 feet, along the easterly line of North Commerce Street and the arc of a curve which has a radius of 879.00 feet with its center lying to the southeast having a central angle of 02°48’42” and whose chord bears South 53°48’32” West 43.13 feet to a point lying 43.00 feet southwesterly of, as measured normal to, the northeasterly line of said certified survey map; thence South 40°41’02” East, parallel to said northeasterly line, 290.32 feet to a point on the northwesterly line of Parcel 3 of said certified survey map and a point on a curve; thence Northeasterly 12.88 feet, along said northwesterly line and the arc of said curve which has a radius of 966.34 feet with its center lying to the northwest having a central angle of 00°45’50” and whose chord bears North 41°27’07” East 12.88 feet to a point; thence North 49°11’13” East, continuing along said northwesterly line, 9.24 feet to the most northerly corner of Parcel 3; thence South 40°41’02” East, along the northeasterly line of Parcel 3 and parallel to the northeasterly line of said certified survey map, 77.67 feet to the most easterly corner of Parcel 3 and a point in the dock line of the right bank of the Milwaukee River, established per Ordinance No. 65, Common Council File No. 69-11, adopted on May 6, 1969; thence North 44°32’03” East, along said dock line, 21.07 feet to the most easterly corner of said certified survey map; thence North 40°41’02” West, along the northeasterly line of said certified survey map, 361.07 feet to the point of beginning.

Resolved, By the Common Council of the City of Milwaukee, that the proper City officials are authorized to accept a quit claim deed to dedicate public right-of-way for the streets illustrated on Certified Survey Map No. 6882 and on the proposed dedications map and as legally identified above.
