Resolution authorizing the Commissioner of Public Works to execute Sewer Easement Amendment SEA-2417, and related Disbursement Agreement, in the vacated Alley in the block bounded by West Oregon Street, West Florida Street, South 2nd Street and South 3rd Street in the 12^th Aldermanic District.

Body

Whereas, On January 20, 1986 the City was granted easement SE-2417, for sewer purposes; and

Whereas, the easement area is in lands owned by Building 41, LLC (“Owner”); and

Whereas, Owner requested City’s permission to construct a building within a portion of the sewer easement in the lands south of West Oregon Street and west of South 2^nd Street; and

Whereas, City is willing to amend said easement to grant Owner permission to construct a mixed-used building over the lands described in Sewer Easement Amendment SEA-2417; and

Whereas, City and Owner wish to enter into a Disbursement Agreement for the disbursement of funds by Owner, said funds are related to the relocation and rehabilitation of a combined sewer main based on the terms contained in Sewer Easement Amendment SEA-2417; now, therefore, be it

Resolved, by the Common Council of the City of Milwaukee, that the proper City officers, are hereby authorized to execute Sewer Easement Amendment document SEA-2417 and Disbursement Agreement, in the form and substance submitted to this file (or in substantially the same form and substance as submitted, and to effectuate the intent of this resolution), or other documents necessary to carry out the work as described in the Sewer Easement Amendment SEA-2417 and cause the Sewer Easement Amendment SEA-2417 to be recorded in the Milwaukee County Register of Deeds Office.
