Analysis
Resolution to amend permission granted to the Wisconsin Center District, as a part of the transfer agreement, for existing items involving the public rights-of-way of West Kilbourn Avenue and West State Street (Auditorium-Arena Complex) by now adding permission for in-ground lighting proposed to be placed in the public right-of-way of North 4th Street in conjunction with and adjacent to their "Walk of Fame Project".
Body
Whereas, the Wisconsin Center District intends to proceed with a "Walk of Fame" project on the North 4th Street side of the U.S. Cellular Arena; and
 
Whereas, The final plans show that most of this project activity is on their property; and
 
Whereas, Some items, in-ground lights and raised curbings around planting areas are to be located in the public right-of-way and, therefore, require Common Council approval which they have requested; and
 
Whereas, In 1995, as a part of the transfer agreement, when they obtained these properties from the City of Milwaukee, they requested and received permission under Common Council Resolution File Number 950096 for an existing non-conforming marquee on West Kilbourn Avenue and an existing backup driveway on West State Street to remain; and
 
Whereas, That file is now to be amended to include the presently proposed items; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee that Common Council Resolution File Number 950096 is hereby rescinded; and, be it
 
Further Resolved, By the Common Council of the City of Milwaukee that the Wisconsin Center District is hereby granted permission for the following:
 
1.  To keep and maintain an existing marquee in the space between the lot line and the curb on the north side of West Kilbourn Avenue at the entrance to the building.  Said marquee is approximately 178 feet long, being approximately 80 feet wider than allowed by Section 245-10 of the Milwaukee Code of Ordinances.  It encroaches 16 feet into the 17-foot wide sidewalk area, has a vertical clearance of approximately 11 feet above the sidewalk grade except for one sign that is hung beneath the midpoint of the marquee, with a 9.1-foot vertical clearance and is centered approximately 160.5 feet west of the westline of North 4th Street.
 
2.  To keep, use and maintain an existing backup driveway located on the south side of West State Street, centered approximately 111 feet east of the eastline of North 6th Street.  The backup driveway is servicing a loading dock area which is approximately 70 feet wide and located approximately 45 feet south of the southline of West State Street.
 
3.  To install and maintain 12 in-ground round modular flush with sidewalk grade, uplights with the accompanying conduits within the west sidewalk area of North 4th Street to light-wash the proposed piers to be placed adjacent on private property all as part of the "Walk of Fame" project.
 
The 12-inch diameter light fixtures shall be centered approximately 1 foot east of the westline of North 4th Street and be generally uniformly located over a distance of approximately 265 feet beginning about 190 feet north of the northline of West Kilbourn Avenue.  The framework and glass of the modular light unit shall provide a supportive strength consistent with that of the adjacent walking surface.
 
4.  To construct and maintain six planters surrounded on each side by 8-inch thick raised concrete curbing creating a space 4-foot wide and 10-foot long for trees and possibly flowers, generally uniformly spaced over a distance of approximately 500 feet beginning at a point about 130 feet north of the northline of West Kilbourn Avenue.  The west edge of the curbing shall abut the main public sidewalk longitudinal joint, being approximately one-half of the distance between the westline of North 4th Street and the back of the roadway curb; and, be it
 
Further Resolved, That this permission is granted only on the condition that Wisconsin Center District shall:
 
1.  Hold the City of Milwaukee or its agents harmless and accept responsibility for any and all liabilities that may arise through implementation of the permission granted herein.
 
2.  Obtain the necessary Department of Public Works and City Development permits for the marquee, the backup driveway, lights, conduit and raised concrete planter walls
 
3.  Whenever the above-mentioned items are no longer needed or when so ordered for public necessity, not only remove the items but shall also restore to its former condition and to the approval of the Commissioner of Public Works any curb, pavement or other public improvement which was removed, changed or disturbed by reason of the granting of this permissory resolution.  Such grantee shall not be entitled to any damages for such removal.
