Title
Resolution authorizing the Commissioner of Public Works to execute a cost sharing agreement with Milwaukee County for the planned improvement from a rural to urban roadway, of South 13th Street between West Rawson Avenue and West College Avenue and authorizing the City Comptroller to establish the necessary accounts to fund the City of Milwaukee’s share of the right-of-way costs of $300,000, of which the Federal/State share is $240,000 and the City’s share is $60,000.
Analysis
This resolution authorizes the Commissioner of Public Works to execute an agreement with Milwaukee County for the City of Milwaukee’s real estate and construction costs associated with the improvement of South 13th Street between West Rawson Avenue and West College Avenue. Milwaukee County has agreed to include those portions of South 13th Street within the City of Milwaukee in their programmed improvement. The estimated real estate cost for those areas within the City of Milwaukee is $300,000, of which the City’s share is $60,000. Total project costs equal $9,264,330 with the City of Milwaukee responsible for approximately 20 percent of $2,160,330 and other governmental agencies responsible for $6,949,000. This resolution also authorizes the City Engineer to sign the relocation order, right-of-way plat, and any other document required by the right-of-way acquisition process for the subject project; and authorizes the City Comptroller to establish the necessary accounts to fund the City of Milwaukee’s share of the right-of-way costs.
Body
Whereas, The Milwaukee County Department of Public Works, in conjunction with the Wisconsin Department of Transportation (WISDOT), has programmed the improvement of South 13th Street between West Rawson Avenue and West College Avenue; and
Whereas, Portions of South 13th Street are under the jurisdiction of the City of Milwaukee; and
Whereas, Common Council file number 030469 authorized engineering for the project; and
Whereas, Going from a rural to urban roadway requires right-of-way acquisition; and
Whereas, The City of Milwaukee has requested and Milwaukee County has agreed to incorporate these portions of roadway that lie within the City of Milwaukee into their paving project; and
Whereas, The City of Milwaukee has requested and received permission from the WISDOT to utilize Federal STP entitlement funds to cover 80 percent of the City of Milwaukee’s share of the engineering, real estate acquisition and construction costs; and
Whereas, Milwaukee County has forwarded an agreement for City of Milwaukee execution which details cost sharing responsibilities for the City of Milwaukee’s real estate acquisition and construction costs associated with the project; and
Whereas, Construction costs will be addressed in a future assessable construction resolution; and
Whereas, Final project costs will be based on actual measured quantities of materials placed within the City of Milwaukee; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works is authorized to execute an agreement with Milwaukee County for the City of Milwaukee’s real estate and construction costs associated with the improvement of South 13th Street between West Rawson Avenue and West College Avenue, a copy of which is attached to Common Council File No. 090797, and is incorporated by reference as though set forth in full; and, be it
Further Resolved, That the City Engineer is authorized to sign the relocation order, right-of-way plat, and any other document required by the right-of-way process for the South 13th Street between West Rawson Avenue and West College Avenue improvement project, whereby the improvement project requires land acquisition from parcels that lie within the City of Milwaukee, and, be it
Further Resolved, That the City Comptroller is authorized to create within the Capital Improvement Fund, Grant and Aid Projects, the necessary accounts for real estate acquisition for the project (Expenditure) and transfer to these accounts the amount required under the grant agreement and City accounting policy, but not to exceed a 10 percent increase of the total amounts reserved for the grantor’s share and local share or $5,000, whichever is greater, as follows:
