Resolution urging the Wisconsin Judicial Conference to increase the scheduled deposit for the counterfeiting of or procuring of special identification cards, issued to persons with disabilities for parking purposes, by fraudulent means.
Analysis
This resolution urges the Wisconsin Judicial Conference to increase the scheduled deposit for the counterfeiting of or procuring by fraudulent means of the special identification cards issued to persons with disabilities for parking purposes. Pursuant to s. 343.52(1m), Wis. Stats., the forfeiture for each offense may be set anywhere between $200 and $500, but is currently set at $200.
This resolution further authorizes and directs the Department of Administration - Intergovernmental Relations Division to use its best efforts to achieve the intent of this resolution.
Body
Whereas, The Statutes of the State of Wisconsin distinguish between 2 general types of offenses relating to the inappropriate use of the special identification cards issued to persons with disabilities for parking purposes, namely identifying a vehicle as operated by or on the behalf of an individual with a card without being authorized to do so and obtaining a card by fraud; and
Whereas, Pursuant to s. 343.52(1)(b), Wis. Stats., the forfeiture for inappropriate use is not to exceed $200 while, pursuant to s. 343.52(1m), Wis. Stats., the forfeiture for obtaining a card by fraud is to be between $200 and $500; and
Whereas, By making this distinction, the state legislature clearly intended to note and appropriately punish the varying degree of severity between these 2 offenses; and
Whereas, Despite this, the deposit for obtaining a card by counterfeit or fraud has been set by the Wisconsin Judicial Conference at a maximum of $200; and
Whereas, This amount does not serve as a sufficient punishment or deterrent for this offense; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the City of Milwaukee urges the Wisconsin Judicial Conference to increase the scheduled deposit for violations of s. 343.52(1m), Wis. Stats., to the maximum permitted by statute; and, be it
Further Resolved, That the Department of Administration - Intergovernmental Relations Division is authorized and directed to use its best efforts to achieve the intent of this resolution.
