This resolution confirms the report of the Commissioner of Public Works, as modified by the Common Council Committee, on projects for which Public Hearings have been held. The resolution authorizes the levying of special assessments and directs the installation and construction of said public improvements.
BODY:
Whereas, The Common Council of the City of Milwaukee adopted preliminary resolutions, determining it necessary and in the public interest to construct and levy special assessments for the following improvements:
3rd Aldermanic District
E. North Ave. - N. Prospect Ave. to a point 150 feet m/l west of N. Oakland Ave. (Including N. Farwell Ave. at E. Kenilworth Pl., N. Prospect Ave. at E. Kenilworth Pl., and N. Prospect Ave. and E. Ivanhoe Pl.) (UR04082000/ST523000101) File Number 981612: Asphalt pavement resurfacing, special treatment, replace curb and gutter, sidewalk and driveway approaches where needed, sodding, and grading. (Nonassessable Project Account Fund 0333 (ST523000100) -- $102,750; BID #20 Fund -- $490,700))

E. Dover St. - S. Kinnickinnic Ave. to S. Howell Ave. (ST21100131) File Number 980909: Asphalt pavement reconstruction. Narrow the roadway from 36 feet to 34 feet. Replace all curb and gutter, replace sidewalk and driveway approaches where needed, sodding, grading, and tree removal where necessary. Whereas, The report of the Commissioner of Public Works has been filed with the City Clerk; and
Whereas, Notices have been sent to all interested persons and public hearings held; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works' Report, as amended at said Public Hearing, is approved and the properties therein identified are benefited; and, be it
Further Resolved, That said Commissioner of Public Works is authorized and directed to proceed with said work in accordance with said report pursuant to Section 66.60 and any other pertinent sections of the Wisconsin Statutes and in the manner directed by Section 115-42 of the Milwaukee Code of Ordinances; and, be it
Further Resolved, That the proper departments take such action as is required of them to assess the abutting or adjacent properties and collect such assessment in the manner directed by Section 115-42 of the Milwaukee Code of Ordinances; and, be it
Further Resolved, That the City Comptroller is authorized and directed to transfer such funds which are available for this purpose to the appropriate capital Project/Grant accounts; and, be it
Further Resolved, That the projects do not involve any parcels of agricultural land which are eligible for deferred special assessments under the provisions of Section 14.30 of the Milwaukee City Charter; and, be it
Further Resolved, That due to the request of the property owners (tax key numbers 038-9979-100-1, 038-9980-0, 038-9981-100-2, 038-9982-110-5, 038-9986-110-X, and 038-9988-100-0) the special assessments for the water main in W. Brown Deer Rd. (WT42090052) be deferred until application for connection to said water main is made. That due to the request of the property owner of tax key number 111-0081-000-1 the special assessment for the water main in W. Liberty Dr. (WT42000002) be deferred until application for connection to said water main is made. That due to the request of the property owner of tax key number 111-0081-000-1 the special assessment for the sanitary and storm sewers in W. Liberty Dr. (SW17200136) be deferred until application for connection to said sewers is made. Cost for deferred charges shall be in accordance with City Charter 12-10; and, be it
Further Resolved, That projects: E. Dover St. (ST21100131), W. Brown Deer Rd. (WT41001063/WT42090052), W. Liberty Dr. (ST21490135), W. Liberty Dr. (SW17200136), and W. Liberty Dr. (WT42000002/WT43093051) will be billed after January 1, 2002, but not before 12 months after the project contract has been completed.
