Whereas, The Department of City Development ("DCD") recommends acceptance of said Offer contingent upon:
 
1. Site and building plan approval by DCD's Planning Division.
 
2. A financial commitment in place to complete the project as proposed.
 
3. Closing must occur within 180 days from the Wisconsin Housing and Economic Development Authority's approval of a housing tax-credit reservation for the project.
 
4. Construction must commence within two months from the date of closing; and
 
Whereas, DCD recommends sale in an "as is" condition without representations or warranties including but not limited to soil quality and subsurface condition; and
 
Whereas, The City Plan Commission has determined that said lots are surplus to municipal needs; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee that said lots are declared surplus; and, be it
 
Further Resolved, That the Offer to Purchase from Revitalize Milwaukee, LLC is accepted and that the Commissioner of DCD, or assigns, is authorized and directed to perform such acts as necessary to carry out the intent of this resolution with the proceeds from sale being credited to the proper account; and, be it
 
Further Resolved, That all of the above-listed primary or alternate sites not developed by Revitalize Milwaukee, LLC shall be released from reserved status for disposition without further Common Council action; and, be it
 
Further Resolved, That in the event the project is rejected for tax-credits or fails to meet submission requirements for the application, the Offer is terminated.
