- Analysis -

 

This ordinance revises various provisions of the code for purposes of correcting errors, clarifying language and eliminating obsolete provisions. Two code sections which are being repealed are 105-63, use of immobilization devices in parking areas, and 110-14, immobilization device tampering. 1995 Wisconsin Act 434, effective July 1, 1997, required municipalities permitting use of immobilization devices to enact ordinances complying with the provisions specified in Act 434. The common council chose not to amend the 2 sections dealing with immobilization devices, initially enacted in May 1995, to comply with Act 434; therefore these provisions are being repealed.

BODY:

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

 

Part 1. Section 105-63 of the code is repealed.

 

Part 2. Section 110-14 of the code is repealed.

 

Part 3. Section 115-44-3-b of the code is amended to read:

 

115-44. Deferred Special Assessments.

 

3.                     ELIGIBILITY.

 

b.                     Have a maximum annual household income of [[$16,000]] >>$17,000<<.

 

Part 4. Section 200-02 of the code is amended to read:

 

200-02. Adoption of State Code. The city of Milwaukee adopts ch. [[ILHR]] >>Comm<< 50, Wis. Adm. Code, as amended, as part of the this code.

 

Part 5. Section 200-30.2-1 of the code is amended to read:

 

200-30.2. Permit Expiration and Renewal.

 

1.                     PERMIT EXPIRATION. Any permit required by s. 200-24 shall expire 2 years from the date of issuance of the permit [[or 2 years from March 3, 1995, whichever is later]]. However, a permit for a structure containing more than 100,000 square fee of floor area shall expire 3 years from the date of issuance [[or 3 years from March 3, 1995, whichever is later]].

 

Part 6. Section 239-8 of the code is amended to read:

 

239-8. Automobile Parking Lot Shelters. Shelter sheds, used in connection with automobile parking lots, and shelter offices used in connection with sale of automobiles or equipment, shall be located as set forth in Table 51-3-A in s. [[ILHR]] >>Comm<< 51.03, Wis. Adm. Code, and shall not exceed an area of 100 square feet and a height of 10 feet.

 

Part 7. Section 275-42-4-0 of the code is amended to read:

 

275-42. Ventilation.
