Substitute resolution relative to application, acceptance and funding of an Erosion Control Information and Training Program grant and authorizing and directing the proper City officers to executive a letter of agreement between the City of Milwaukee and the Great Lakes Commission regarding the grant.
Analysis
This resolution authorizes the Department of Public Works to apply for, accept and fund an Erosion Control Information and Training Program grant from the Great Lakes Commission in the amount of $80,056.00 with a city share of $30,056.00 and a grantor share of $50,000.00  The purpose of the grant is to aid in funding the development of informational and training programs regarding sedimentation and erosion control during construction.  This resolution also authorizes and directs the proper City officers to execute a letter of agreement between the City of Milwaukee and the Great Lakes Commission regarding the project grant.
Body
Whereas, Erosion control during construction operations is an important component of the City of Milwaukee (City) storm water permit with the Department of Natural Resources (DNR); and
 
Whereas, The lack of erosion control devices and enforcement activities in past public and private construction activities has resulted in stipulations and orders for judgments being filed against the City by the State of Wisconsin on behalf of the DNR; and
 
Whereas, To comply with the stipulations, the City previously retained a consultant to evaluate the City's storm water and construction site runoff programs; and
 
Whereas, The consultant has recommended that the City create a formalized training program for construction erosion control; and
 
Whereas, The City is eligible for grant funds from the Great Lakes Commission (GLC) under the Great Lakes Basin Program for Soil Erosion and Sediment Control; and
 
Whereas, The City has submitted a proposal to the Great Lakes Commission titled "City of Milwaukee Erosion Control Information and Training Program", a copy of said proposal being attached to this file and incorporated in this resolution as though set forth in full; and
 
Whereas, The Great Lakes Commission has informed the City that our proposal has been approved for funding in a letter dated May 23, 2005, a copy of said letter being attached to this file and incorporated in this resolution as though set forth in full; and
 
Whereas, The operation of this grant for the City of Milwaukee Erosion Control Information and Training Program from July 1, 2005 through June 30, 2006 is estimated to cost $80,056.00 of which $30,056.00 (37.54%) would be provided by the City and $50,000.00 (62.46%) would be provided by the Great Lakes Commission; and
 
Whereas, The scope and duration of the grant, the project deliverables, payments and other details required to coordinate the work and complete the project as intended have been outlined by the Great Lakes Commission in the aforementioned letter; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the proper City officers and/or the herein named department head are hereby authorized to apply for and accept such a grant without further Common Council approval unless the terms of the grant change as indicated in Common Council file 030712 (Grant Ordinance); and, be it
 
Further Resolved, That the City Comptroller is authorized to:
 
1.  Commit funds within the Project/Grant Parent of the 2005 Special Revenue-Grant and Aid Projects and fund the following amount for the project titled, "City of Milwaukee Erosion Control Information and Training Program":

2.   Create the necessary Grant and Aid Project/Grant and Project/Grant Levels; budget against these Project/Grant values the amount required under the grant; and, be it
      
Further Resolved, That these funds are budgeted for the Department of Public Works which is authorized to expend from the amount budgeted for specific purposes as indicated in the grant and incur costs consistent with the grant; and, be it
 
Further Resolved, That the grant funds received from the Great Lakes Commission be deposited in accordance with procedures established by the City Comptroller; and, be it
 
Further Resolved, That the proper City officers are authorized and directed to execute the letter of agreement from the Great Lakes Commission regarding the City of Milwaukee Erosion Control Information and Training Program grant; and, be it
 
Further Resolved, That the authority hereby conferred upon the City officers to execute the letter of agreement includes the authority to make and/or negotiate reasonable modifications that do not substantially change the intent of the agreement; and, be it
 
Further Resolved, That Infrastructure Services/Sewer Maintenance commit $30,056.00 to fund the City share of the program titled "City of Milwaukee Erosion Control Information and Training Program":

Further Resolved, That the Common Council directs that the 2005 Positions Ordinance C.C. File Number 040459, should be amended as follows:

Add footnote (B) to the following positions:
