Resolution approving installation of public improvements (street lighting) on West Vliet Street from North 47th Street to North 60th Street to be paid for through a combination of special assessments and City funds. (DPW)
Analysis
This resolution authorizes the installation of harp lights and Milwaukee lantern-style street lights along West Vliet Street between North 47th and North 60th Streets.
Body
Whereas, The City of Milwaukee has cooperated with a variety of business organizations throughout the city on streetscape improvement projects; and
 
Whereas, Past streetscaping projects have led to increased private investment in the benefited commercial districts with a resultant increase in property tax base; and
 
Whereas; The West Vliet Street business association has requested that lighting improvements consisting of Milwaukee Lantern-style street lights and harp lights be installed along Vliet Street between North 47th and North 60th Streets at an estimated total cost of $400,000; and
 
Whereas, In the past the City of Milwaukee has paid one half the cost of streetscape improvements with the other half being funded by private property owners within the business district; and
 
Whereas, West Vliet Street between North 47th and North 60th Streets is not a typical business district because of the relatively large number of  public and residential uses interspersed among the street's commercial establishments; and
 
Whereas, This unique blend of land uses requires a unique funding strategy for the proposed street lighting improvements; and
 
Whereas, That funding strategy consists of special assessments against benefited property owners along with use of capital account funds from both the Departments of Public Works and City Development; and
 
Whereas, The DPW street lighting capital fund contribution to the project will be less than the amount the fund would pay to cover assessments of City and School Board property if the lighting improvements were undertaken as a traditional special assessment project, thereby rendering the funding strategy consistent with the policy directive of Common Council file number 941467; and
 
Whereas, The Common Council of the City of Milwaukee has adopted a preliminary resolution determining it to be in the public interest to install and to levy assessments for street lighting improvements along West Vliet Street between North 47th and North 60th Streets; and
 
Whereas, The report of the Commissioner of Public Works has been filed with the City Clerk, notices have been sent to all interested persons and a public hearing has been held; now, therefore, be it    
 
Resolved, By the Common Council of the City of Milwaukee that the Commissioner of Public Works' Report is hereby approved and the properties therein identified are found to be benefited; and, be it
 
Further Resolved, That the Commissioner of Public Works is authorized and directed to proceed with the street lighting improvements in accordance with the report pursuant to Section 66.60 and any other pertinent sections of Wisconsin Statutes and in the manner directed by Section 115-42 of the Milwaukee Code of Ordinances; and, be it
 
Further Resolved, That the proper departments take such action as is required of them to assess the abutting or adjacent properties and collect such assessments in the manner directed by Section 115-42 of the Milwaukee Code of Ordinances; and, be it
 
Further Resolved, That the City Comptroller is authorized and directed to complete the following fund transfers:
 
1.      $115,600 from the Street Improvements - Street Lighting Account
(Account # ST240010000) to a new West Vliet Street Lighting Project Private Property Assessments sub-account.
 
2.      $34,400 from the Street Improvements - Street Lighting Account
(Account #ST240010500) to a new West Vliet Street Lighting Project Public Property Assessments sub-account.
 
3.      $250,000 from the Development Fund (Account #UR033000000) to a new West Vliet Street Lighting Project City Share sub-account (Account #UR03393000); and, be it
 
Further Resolved, That the City Comptroller, in cooperation with the Departments of City Development and Public Works, be and is hereby authorized and directed to establish any and all sub-accounts, in accordance with generally accepted accounting practices consistently applied and City of Milwaukee guidelines, necessary to maintain the fiscal control required to carry out the intent and purpose of this resolution; and, be it
 
Further Resolved, That the West Vliet Street Lighting Project does not involve any parcels of agricultural land which are eligible for deferred special assessments under the provisions of Section 14.30 of the Milwaukee City Charter; and, be it
 
Further Resolved, That the West Vliet Street Lighting Project will be billed after January 1, 2002 but not before 12 months after the project contract has been completed.
