This resolution also authorizes settlement of claims raised by the Plaintiffs, 875 EAST 1, LLC, 875 EAST 2, LLC, 875 EAST 3, LLC,875 EAST 4, LLC, 875 EAST 5, LLC, 875 EAST 6, LLC, 875 EAST 7, LLC, 875 EAST 8, LLC, 875 EAST 9, LLC, 875 EAST 11, LLC, 875 EAST 12, LLC, 875 EAST 13, LLC, 875 EAST 15, LLC, 875 EAST 17, LLC, 875 EAST 18, LLC, 875 EAST 19, LLC, 875 EAST 20, LLC, 875 EAST 21, LLC, 875 EAST 22, LLC, 875 EAST 25, LLC, 875 EAST 26, LLC, 875 EAST 27, LLC, 875 EAST 28, LLC, 875 EAST 29, LLC, 875 EAST 30, LLC, 875 EAST 32, LLC, 875 EAST 33, LLC, 875 EAST 34, LLC, 875 EAST 35, LLC, 875 EAST 36, LLC, and 875 EAST 37, LLC (collectively, “875 East”), in the lawsuits entitled 875 East 1, LLC et al. v. City of Milwaukee (Milwaukee County Case No. 23CV4513), 875 East 1, LLC et al. v. City of Milwaukee Board of Review (Wisconsin Court of Appeals Case No. 24AP2411), 875 East 1, LLC et al. v. City of Milwaukee (Milwaukee County Case No. 24CV499), 875 East 1, LLC et al. v. City of Milwaukee (Milwaukee County Case No. 25CV2465), and 875 East 1, LLC v. City of Milwaukee (Milwaukee County Case No. 26CV5913) for the total amount of $301,869.53.

Whereas, 875 East filed lawsuits against the City entitled 875 East 1, LLC, et al. v. City of Milwaukee, Milwaukee County Case Nos. 23CV4513, 24CV499, 25CV2465, and 26CV5913, for the partial refund of property tax previously paid for its property at 875 East Wisconsin Avenue on the basis that its 2020, 2022, 2023, 2024, and 2025 property tax assessments were excessive and violated Article VIII, section I of the Wisconsin Constitution (“Uniformity Clause”); and
Whereas, 875 East filed a lawsuit against the City of Milwaukee Board of Review entitled 875 East 1 LLC, et al. v. City of Milwaukee Board of Review, Milwaukee County Case No. 23CV4534 (on appeal as 24AP2411), on the basis that the Board of Review erred in sustaining the City’s assessment of its property for 2021; and
Whereas, 875 East has agreed to settle the claims raised in the above-referenced lawsuits and regarding its assessments for the total amount of $301,869.53; and
Whereas, The City Attorney recommends that the City of Milwaukee settle these lawsuits and resolve these claims; and
Whereas, Common Council File Number 251996, adopted April 21, 2026, authorized settlement of various lawsuits filed by 875 East, LLC, for the total amount of $604,826.61; and
Whereas, Common Council File Number 251996 contained errors relating to the source of funds and the total settlement amount; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that Common Council File Number 251996, adopted April 21, 2026, is rescinded; and, be it
Further Resolved, By the Common Council of the City of Milwaukee, the City Attorney is authorized to enter into a settlement agreement between the City of Milwaukee and 875 East and to execute and approve all documents and take all action necessary to carry out the terms and conditions of said agreement; and, be it
Further Resolved, That, in compliance with the City Attorney’s direction, the proper City officers are authorized and directed to issue two City checks in full and final settlement of the claims referenced above, to be charged to the Remission of Taxes Special Purpose Account No. 0001-9990-S163-006300; and, be it
Further Resolved, The first check shall reflect partial refunds for tax years 2020 and 2022, and shall be issued in the sum of $219,800.38, and made payable to the Trust Account of Rogahn Jones, LLC, and mailed to Rogahn Jones LLC at N16W23233 Stone Ridge Drive #270, Waukesha, WI 53188; and, be it
Further Resolved, The second check shall reflect partial refunds for tax years 2023 and 2024 and shall be issued in the sum of $82,069.15, and made payable to the Trust Account of Reinhart Boerner Van Deuren, S.C., and mailed to Reinhart Boerner Van Deuren at 22 East Mifflin Street, Suite 700, Madison, WI 53703; and, be it
Further Resolved, The above payments total $301,869.53 and constitute final settlement of these claims and lawsuits; and, be it
Further Resolved, That the above-referenced payments are conditioned upon 875 East signing a settlement agreement promising, upon payment, to sign stipulations and proposed orders dismissing the pending court actions, including the pending court action for tax year 2025, and withdrawing any pending objection for tax year 2026.
