Title

Resolution authorizing acceptance of a quit claim deed to dedicate a portion of North Lauer Street at the southeast corner of West Brown Deer Road for public right-of-way, in the 9th Aldermanic District.

Analysis

This resolution permits the City of Milwaukee to accept a quit claim deed to dedicate land for public right-of-way.

Body

Whereas, On February 12, 2007, the City Plan Commission approved the site plan for the Kohl’s Department Store Photo Studio at 11300 West Heather Drive, which was within the Towne Corporate Park of Granville Development Incentive Zone (“DIZ”); and

 

Whereas, The DIZ approval required dedication of approximately 330 square feet of land at the southeast corner of North Lauer Street and West Brown Deer Road as public right-of-way to accommodate sidewalk improvements as illustrated on the site plan and a copy of which is attached to this Common Council File as Exhibit A; and

 

Whereas, Kohl’s Department Stores, Inc., has agreed to quit claim to the City of Milwaukee for no monetary consideration the land illustrated in Exhibit B, a copy of which is attached to this Common Council File, for dedication as public right-of-way; and

 

Whereas, The legal description of the property to be acquired and dedicated is as follows:

 

That part of Parcel 2 of Certified Survey Map No. 6674 in the Northeast 1/4 of Section 7, Township 8 North, Range 21 East, described as follows: Commencing at the northwest corner of Parcel 2; thence Northeasterly 20.00 feet, along the northerly line of Parcel 2 and the arc of a curve which has a radius of 2,366.83 feet with its center lying to the north having a central angle of 00°29’03” and whose chord bears North 85°01’38.5” East 20.00 feet to a point; thence South 29°19’51” West 40.05 feet to a point in the west line of Parcel 2; thence North 00°30’45” West, along said west line, 33.18 feet to the point of commencement; and

 

Whereas, The City Plan Commission has approved acquisition and dedication of land for this public right-of-way during approval of the DIZ application by Kohl’s Department Stores, Inc., for 11300 West Heather Drive; now, therefore, be it

 

Resolved, That the Common Council of the City of Milwaukee, is authorized to accept a quit claim deed from Kohl’s Department Stores, Inc., to dedicate a portion of North Lauer Street at the southeast corner of West Brown Deer Road as public right-of-way as illustrated on the Exhibits and as legally described above.
