- Analysis -

 

This resolution will accept portions of reservations for street, thereby opening them for public street purposes, and retain the remaining portion of reservation for street.

 

 

BODY:

Whereas, A reservation for street was created, for the opening of West Kiehnau Avenue, by Warranty Deed dated October 31, 1968, recorded in the Office of the Register of Deeds of Milwaukee County as Document No. 4427047 in Reel 448 Image 1128 on October 31, 1968; and

 

Whereas, Reservations for street were created, for the opening of North 108th Street, by Certified Survey Map No. 6427 and by Warranty Deed dated April 17, 1997, recorded in the Office of the Register of Deeds of Milwaukee County as Document No. 7410295 in Reel 4121 Image 1784 on August 20, 1997; and

 

Whereas, The property owners to the north are subdividing their land and are requesting that the City of Milwaukee accept these reservations for opening portions of West Kiehnau Avenue and North 108th Street; and

 

Whereas, The City of Milwaukee will retain the remaining portion of the reservation for West Kiehnau Avenue for possible future use; now, therefore, be it

 

Resolved by the Common Council of the City of Milwaukee, that the following described parcels of land, which have been reserved for public street purposes, hereby are declared open for such purposes:

 

Parcel 1

 

The west 30.00 feet of Parcel 2 in Certified Survey Map No. 6427 in the Southeast 1/4 of Section 19, Township 8 North, Range 21 East.

 

Parcel 2

 

The east 30.00 feet of a portion of lands in the Southeast 1/4 of Section 19, Township 8 North, Range 21 East, described as follows: Commencing at the northeast corner of said 1/4 Section; thence South 00 deg. 47 min. 19 sec. East, along the east line of said 1/4 Section, 797.00 feet to a point; thence South 87 deg. 10 min. 03 sec. West 442.30 feet to the point of beginning of the land to be described, said point being the southwest corner of Certified Survey Map No. 6427; thence continuing South 87 deg. 10 min. 03 sec. West 150.10 feet to a point, thence North 00 deg. 47 min. 19 sec. West, parallel to said east line, 137.00 feet to a point in the south line of Certified Survey Map No. 6531; thence North 87 deg. 10 min. 03 sec. East, along said south line, 150.10 feet to a point in the northwest corner of Certified Survey Map No. 6427; thence South 00 deg. 47 min. 19 sec. East, parallel to said east line, 137.00 feet to the point of beginning.

 

Parcel 3

 

A 60-foot wide strip of land in the Southeast 1/4 of Section 19, Township 8 North, Range 21 East, which is bounded on the north by a line which lies 796.49 feet south of, as measured normal to, the north line of said 1/4 Section, on the east by a line which lies 252.12 feet westerly of, as measured normal to, the east line of said 1/4 Section and on the west by a line which lies 712.03 feet westerly of, as measured normal to, the east line of said 1/4 Section; and, be it

 

Further Resolved, That the City Comptroller is hereby directed to have a certified copy of this resolution recorded in the Office of the Register of Deeds of Milwaukee County.
