REVOCATION OF ROOMING HOUSE LICENSES OF JAMES DECHERT FOR THE PREMISES AT 3410,3413 W. WELLS STREET And 3305 W. CLYBOURN STREET. (4th Ald. Dist.) REVOCATION OF THE CLASS "B" TAVERN AND ALL TAVERN RELATED LICENSES OF RICHARD DIONE POLK FOR THE PREMISES LOCATED AT 5300 W. VILLARD AVENUE. (1st Ald. Dist.) Ayes: 16 - Ald. Pratt, D'Amato, Henningsen, Schramm, Johnson-Odom, Frank, Richards, Butler, Scherbert, Witkowiak, Pawlinski, Breier, Nardelli, Murphy, Hines and President Kalwitz. Noes: 0. Excused: 1 - Ald.Gordon. THE CHAIR questioned whether any of the applicants or their counsel were present and wished to address the Council. James Dechert relating to File 961771, 961772 and 961773. The counsel and the applicant were present. ALD. SCHRAMM moved that the Common Council do now resolve itself into a Committee of the Whole for the purpose of hearing from the applicant's attorney and Assistant City Attorney. PROCEEDINGS OF THE COMMITTEE OF THE WHOLE Attorney James Locke and Assistant City Attorney Bruce Schrimpf appeared and addressed the Committee relative to the foregoing matter. ALD. Butler moved that the Committee do now rise. The motion prevailed. Richard Dione Polk - The applicant or his counsel were not present ALD. WITKOWIAK requested a roll call vote to approve the recommendations of the Utilities and Licenses Committee on File Number 961771, 961772, 961773 and 971309. The motion prevailed by the following vote: Ayes: 16 - Ald. TITL:

Substitute motion to approve the recommendation of the Utilities and Licenses Committee relative to the request for the revocation of a Class "B" Retailer's Intoxicating Liquor license of Richard Dione Polk, licensee for the "Next Best Thing", located at 5300 West Villard Avenue, in the 1st Aldermanic District.

ANLS:

This substitute motion revokes the Class "B" Retailer's Intoxicating Liquor license of Richard Dione Polk, for the "Next Best Thing", located at 5300 West Villard Avenue, in the 1st Aldermanic District.

BODY:

Whereas, The Utilities and Licenses Committee held an evidentiary hearing on January 9, 1998, at 9:00 A.M., relative to the revocation of the Class "B" Retailer's Intoxicating Liquor license for Richard Dione Polk, licensee for "Next Best Thing" for the premises located at 5300 West Villard Avenue; and

 

Whereas, The Committee found that the premise operated in violation of the ordinances of the City of Milwaukee, and otherwise constitutes a substantial and adverse threat to the health, safety, convenience and prosperity of the immediate neighborhood and that it is in the best interest of the community that the license of the Licensee, Richard Dione Polk, for the "Next Best Thing", located at 5300 West Villard Avenue, be revoked; and

 

Whereas, The Utilities and Licenses Committee, after hearing all of the testimony of the complainants, the Milwaukee Police Department, neighborhood witnesses, voted unanimously (5 ayes and 0 noes) to recommend revocation of said license; now, therefore, be it

 

Resolved, That the Common Council of the City of Milwaukee, hereby accepts the recommendation of the Utilities and Licenses Committee and finds true the allegations of the complaint and hereby revokes the Class "B" Intoxicating Liquor license of Richard Dione Polk for "Next Best Thing" at 5300 West Villard Avenue, based upon police and neighborhood objections.
