Title
Substitute resolution to vacate the three right-turn bypasses at the intersection of West Michigan Street and North 6th Street, in the 4th Aldermanic District.
Analysis
This substitute resolution vacates the above right-turn bypasses in accordance with vacation proceedings under power granted to the City of Milwaukee by Section 66.297(1), Wisconsin Statutes, and Section 81-308-28, Milwaukee Code of Ordinances. This vacation was requested by the Department of Public Works since the excess right-of-way is no longer necessary.
Body
Whereas, It is proposed that the three right-turn bypasses located at the intersection of West Michigan Street and North 6th Street be vacated pursuant to the provisions of Section 62.73, Wisconsin Statutes; and
 
Whereas, The Department of Public Works has been authorized and directed to prepare a coordinated report estimating all costs and benefit assessments that will be incurred with said vacation; and
 
Whereas, Said vacation has been reviewed in accordance with Sections 81-116-1 and 308-28, Milwaukee Code of Ordinances; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee that said right-turn bypasses, as indicated by Exhibit A and bound and described by:
 
Parcel 1:
 
That part of the Southwest 1/4 of Section 29, Township 7 North, Range 22 East, described as follows:
 
Commencing at the Southeast corner of Lot 7 in Block 66 of East Half of the South West Quarter, a recorded subdivision, in said 1/4 Section; thence Easterly, along the south line of said Block 66, as originally platted, to a point lying 40.00 feet West of, as measured normal to, the original east line of said Block 66; thence Northerly, parallel to said original platted east line, to a point in the north line of Lot 10 in Block 66; thence Southwesterly, along the present westerly line of North 6th Street, to a point lying 69.00 feet West of, as measured normal to, the original platted east line of Block 66 and 39.00 feet North of, as measured normal to, the original platted south line of Block 66; thence Southwesterly, along said present westerly line, 29.00 feet to a point lying 19.00 feet North of, as measured normal to, the original platted south line of Block 66 and 60.00 feet East of, as measured normal to, the west line of Lot 8 in said Block 66; thence Southwesterly, along the present northerly line of West Michigan Street, 60.67 feet to a point in the west line of said Lot 8, said point lying 10.00 feet North of the original Southwest corner of said Lot 8; thence Southwesterly to the point of commencement.

That part of the Southwest 1/4 of Section 29, Township 7 North, Range 22 East, described as follows:
 
Commencing at the Northeast corner of Lot 4 in Block 79 of East Half of the South West Quarter, a recorded subdivision, in said 1/4 Section; thence Southerly, along the east line of Lot 4 aforesaid, 10.00 feet to a point; thence Easterly, parallel to the north line of Block 79, as originally platted, 28.00 feet to a point; thence Southeasterly along the present southerly line of West Michigan Street, to a point lying 39.60 feet South of, as measured normal to, the original platted north line of Block 79 and 46.82 feet East of, as measured normal to, the west line of Lot 2 in said Block 79; thence Southeasterly, along said present southerly line, to a point in the present west line of North 6th Street; thence Northerly, along the Northerly extension of the present west line of North 6th Street, 47.68 feet to a point in the original platted north line of Block 79; thence Westerly, along said original platted north line, to the point of commencement.
 
Parcel 3:
 
That part of the Southwest 1/4 of Section 29, Township 7 North, Range 22 East, described as follows:
 
Commencing at the point of intersection of the original platted west line of Lot 6 in Block 78 of East Half of the South West Quarter, a recorded subdivision, in said 1/4 Section and the Westerly extension of the present south line of West Michigan Street; thence Easterly, along said Westerly extension, 36.00 feet to a point; thence Southwesterly, along the present easterly line of North 6th Street, to a point lying 8.00 feet South of, as measured normal to, the present south line of West Michigan Street extended West and 26.80 feet East of, as measured normal to, the original platted west line of Lot 6; thence Southwesterly, along said present easterly line, to a point lying 85.00 feet South of, as measured normal to, the present south line of West Michigan Street extended West and 10.00 feet East of, as measured normal to, the original platted west line of Lot 6; thence Southwesterly, along said present easterly line, 29.73 feet to a point in the original platted west line of Lot 6; thence Northerly, along the original platted west line of Lot 6 to the point of commencement, is vacated; and, be it
 
Further Resolved, That upon deposit of the funds required, the Commissioner of Public Works and/or the City Engineer are authorized to implement actions listed in the coordinated report relating to said vacation; and, be it
 
Further Resolved, That as provided by Section 80.32(4), Wisconsin Statutes, said vacation shall not terminate the easements and rights incidental thereto acquired by or belonging to any county, town, village or city, or to any utility or person in any underground structures, improvements or services, as enumerated or otherwise existing in said description of land above described, both easements and rights and all rights of entrance, maintenance, construction and repair with reference thereto shall continue as if said right-turn bypasses had not been vacated.
