Title
Resolution directing the Intergovernmental Relations Division-Department of Administration to urge the Conference Committee on Senate Bill 40, as amended, to remove ss. 2913c to 2913e, relating to the issuance of fireworks permits and the sale of fireworks, from the state budget.
Analysis
This resolution directs the Intergovernmental Relations Division-Department of Administration to urge the state Conference Committee to delete provisions relating to the issuance of fireworks permits and the sale of fireworks from the state budget, and if they are not deleted then to urge the Governor to delete the provisions before approving the state budget.
Current state law holds that fireworks may not be used or possessed without a permit, which may not be issued to individuals, and holds that resident wholesalers may only sell fireworks to persons physically located outside the state. The Senate and Assembly budget bills before the Conference Committee contain provisions which weaken current state law as it relates to fireworks. If these provisions are passed as part of the state budget, they will have the effect of increasing the possession and use of fireworks in the city by making it possible for any individual to purchase fireworks which are prohibited by state law and city ordinance from vendors in the immediate vicinity of the city, and allowing wholesale vendors to sell fireworks to non-residents within the state, which will be likely used within the state.

Whereas, Current state law holds that fireworks may not be used or possessed without a permit, which may not be issued to individuals, and holds that resident wholesalers may only sell fireworks to persons physically located outside the state; and
Whereas, All fireworks within the city of Milwaukee that are not part of a permitted fireworks display are illegal, and the prevalence of illegal fireworks in the city creates substantial public health and safety risks, and at great expense to public resources; and
Whereas, The Senate and Assembly budget bills before the Conference Committee contain provisions which weaken current state fireworks regulations by allowing any single individual to be issued a fireworks permit and wholesalers to sell fireworks to non-residents within the state; and
Whereas, If these provisions are passed as part of the state budget, they will make it possible for any individual to purchase fireworks which are prohibited by state law and city ordinance from vendors in the immediate vicinity of the city, and will have the effect of legalizing fireworks within the state; and
Whereas, If these provisions are passed, they will also allow wholesale vendors to sell fireworks to non-residents within the state, which will be likely used within the state; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the Common Council directs the Intergovernmental Relations Division-Department of Administration to urge the Conference Committee on Senate Bill 40, as amended, to remove ss. 2913c to 2913e, relating to the issuance of fireworks permits and the sale of fireworks, from the state budget; and, be it
Further Resolved, That if ss. 2913c to 2913e of Senate Bill 40, as amended, should pass the Conference Committee, then the Common Council directs the Intergovernmental Relations Division-Department of Administration to urge the Governor to veto these provisions from the state budget.
