Title

Substitute ordinance relating to disallowing and refusing fire escape critical examination reports submitted by registered architects and registered structural engineers.

Analysis

This ordinance establishes the power and authority of the commissioner of neighborhood services to do the following if upon inspection the department finds any fire escape is defective or unsafe for any reason whatsoever:

1.  Disallow any fire escape critical examination report, submitted within 120 days prior to the date of the inspection by the department, showing the structural condition of the fire escape and its supports to be in good repair and safe condition.

2.  Refuse to accept any future fire escape critical examination report relating to any other fire escape submitted by the same registered architect or registered structural engineer.

Body

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

 

Part 1.  Section 214-19-3 of the code is created to read:

 

214-19.                     Fire Escape Inspections.

 

3.  REVIEW OF CRITICAL EXAMINATION REPORT.  a. Disallowance and Refusal.  If upon inspection the department finds any fire escape is defective or unsafe for any reason whatsoever, the commissioner shall have the following power and authority to:

a-1.   Disallow any fire escape critical examination report, submitted within 120 days prior to the date of the inspection by the department, showing the structural condition of the fire escape and its supports to be in good repair and safe condition.

a-2.  Refuse to accept any future fire escape critical examination report relating to any other fire escape submitted by the same registered architect or registered structural engineer.

b.  Appeal.  Any person having a fire escape critical examination report disallowed or refused by the commissioner may appeal the decision to the standards and appeals commission.
