- Analysis -

 

Under s. 36-05-5 of the charter, widows of employes

who die while in the performance of duty are entitled

to a pension of 60% of the deceased employe's final

average salary, and return of member contribution.

This charter ordinance makes widows of deceased

employees who died prior to January 1, 1993, while in

the performance of duty eligible for a catch-up

adjustment and escalator as provided to widows of

service retirees retiring prior to January 1, 1993 in

s. 36-05-1-i-1-b and 2-b.

BODY:

The Mayor and Common Council of the City of Milwaukee

do ordain as follows:

 

Part 1. Section 36-05-5-d is created to read:

 

36-05. Benefits.

 

5. ACCIDENTAL DEATH BENEFIT.

 

d. A widow or widower of a member who died prior to

January 1, 1993, who is receiving a pension under

par. a-2 shall be eligible for catch-up under sub. 1-

i-1-b and an escalator under sub. 1-i-2-b during the

period of such widow's eligibility. In computing

such catch-up and escalator, the member's date of

death shall be considered the member's date of

service retirement. No other beneficiaries under

par. a shall be eligible for either catch-up or an

escalator.

 

Part 2. This is a charter ordinance and shall take

effect 60 days after its passage and publication,

unless within such 60 days a referendum petition is

filed as provided in s. 66.01(5), Wis. Stats., in

which event this ordinance shall not take effect

until submitted to a referendum and approved by a

majority of the electors voting thereon.
