Substitute resolution authorizing and directing the proper City Officials to petition the State of Wisconsin, Office of the Commissioner of Railroads as necessary to facilitate various rail modifications associated with the improvement of West Canal Street from 6^th Street to Miller Park Way in the Menomonee Valley.

Body

Whereas, Common Council Resolution File Number 010651 authorized and directed the Commissioner of Public Works to execute a Project Agreement with the Wisconsin Department of Transportation for the programming and preliminary engineering for the Canal Street Reconstruction/Extension project; and

Whereas, The Canal Street Reconstruction/Extension project will include relocation of an existing spur track within the Canal Street roadway to an alternate location outside of the roadway; and

Whereas, The relocated spur track will establish a new at-grade railroad crossing over South 11^th Street; and

Whereas, It appears that the new spur track will not achieve statutory horizontal and vertical clearance requirements; and

Whereas, Approval from the State of Wisconsin, Office of the Commissioner of Railroads is necessary for the establishment of the new at-grade crossing and construction of the new spur that does not meet statutory clearance requirements; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee that the proper City officials, in conjunction with WISDOT officials, are authorized and directed to petition the Office of the Commissioner of Railroads of the State of Wisconsin to facilitate various rail modifications associated with the improvement and extension of West Canal Street between North 6^th Street and Miller Park Way in the Menomonee Valley.
