Title
Substitute resolution establishing a policy for the acceptance of grants for additional law enforcement services from tax exempt public or quasi-public entities and relative to application, acceptance and funding of a Bradley Center Program Grant (Police Department), and approving a Law Enforcement Services Grant Agreement with the Bradley Center Sports and Entertainment Corporation.
Analysis
This resolution establishes a policy for the acceptance of grant funds for additional law enforcement services from tax exempt public or quasi-public entities that own and operate large venues open to the public and, in accordance with that policy, the resolution authorizes the Chief of the Police Department to enter into a Law Enforcement Services Grant Agreement with the Bradley Center Sports and Entertainment Corporation, a public body corporate and politic created under the provisions of sec. 232.03(1), Stats. The agreement provides for the following:
 
1. The Milwaukee Police Department (MPD) will provide two police officers for duty inside the Bradley Center for certain selected events.
 
2. The Bradley Center may request additional officers, and the Chief of Police is authorized to provide additional officers under the terms of the agreement.
 
3. The Bradley Center will compensate the MPD for the officers' actual overtime costs up to a total of $162,000 over the next 2-year period.
 
In addition, this resolution authorizes the Milwaukee Police Department to apply for, accept and fund a Bradley Center Program Grant from the Bradley Center in the amount of $308,308 with a city share of $146,308 and a grantor share of$162,000. The purpose of the project is to provide on-premise security at selected events held at the Bradley Center.
Body
Whereas, The Common Council of the City of Milwaukee finds that:
 
1. Large facilities open to the public operated by tax-exempt public or quasi-public entities (hereinafter referred to as "Public Venue(s)") often require additional law enforcement services in order to meet the needs of public safety and convenience;
 
2. The public or quasi-public entities operating those Public Venues are often exempt from general property taxation and therefore, absent a voluntary agreement, would not have to pay for the provision of such law enforcement services;
 
3. Therefore, based upon the above enumerated considerations, the Common Council hereby finds that the City or its Police Department ("MPD") are authorized, upon passage of an enabling resolution by the Common Council, to accept grants to fund law enforcement services, provided that such grant(s) are received from entities that meet all of the following criteria:
 
a.      The entity is exempt from general property taxation;
 
b.      The entity is either public or quasi-public in nature; and
 
c.      The entity owns and/or operates a Public Venue.
 
; and
 
Whereas, The Common Council further finds that accepting grants from public or quasi-public entities qualifying under the criteria set forth above is in the public interest because:
 
1. The grant will enable the MPD to assign additional personnel to that Public Venue and thereby enhance public safety and convenience at that venue; and
 
2. The grant will relieve the general City property taxpayers from funding the cost of the additional law enforcement services being provided to the tax exempt entity operating the Public Venue; and
 
Whereas, The Bradley Center Sports and Entertainment Corporation ("Bradley Center") is a public body corporate and politic created under the provisions of sec. 232.03(1), Stats.; and
 
Whereas, The Bradley Center owns and operates a large sports and entertainment venue open to the public and, which on a per event basis, can accommodate in excess of 18,000 members of the public; and
 
Whereas, All real and personal property owned and operated by the Bradley Center is exempt from general property taxation pursuant to sec. 70.11(29m), Stats.; and
 
Whereas, Based upon the above enumerated policy criteria and findings, the MPD is eligible for grant funds from the Bradley Center for a Bradley Center Grant to fund additional law enforcement services; and
 
Whereas, The Bradley Center has requested the provision of on-premise Milwaukee Police Department services; and
 
Whereas, The Chief of Police has indicated a willingness to provide these services in accordance with the terms and conditions of the grant agreement attached to this file; and
 
Whereas, The operation of this grant from 1/01/2002 to 12/31/2003 would cost $308,308 of which $146,308 (47%) would be provided by the city and $162,000 (53%) would be provided by the grantor; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee that grants for the provision of additional law enforcement services be accepted if the grantor qualifies under the criteria established in Section 3 of the first recital of this resolution; and, be it
 
Further Resolved, By the Common Council of the City of Milwaukee, that the grant application for the Bradley Center meets all criteria established in section 3 of the first recital of this resolution and, on that basis, the MPD shall accept this grant without further approval unless the terms of the grant change, as indicated in Common council file 940843; and, be it
 
Further Resolved, That the Chief of Police is authorized to execute the Law Enforcement Services Grant Agreement with the Bradley Center Sports and Entertainment Corporation, a copy of which is attached to this file; and, be it
 
Further Resolved, That the City Comptroller is authorized to:
 
1. Commit funds within the Project/Grant Parent of the 2002 Special Revenue-Grant and Aid Projects Fund, the following amount for the program titled: "Bradley Center Grant":

Further Resolved, That these funds are budgeted for the Milwaukee Police Department, which is authorized to:
 
1. Expend from the amount budgeted sums for the specified purposes, as indicated in the grant budget and incur costs consistent with the award date.
 
2. Transfer funds within the project budget as long as the amount expended for each specific purpose does not exceed the amount authorized by the budget by 10%.
