Title
Resolution directing the Commissioner of Public Works to execute a revised project agreement titled “State/Municipal Agreement for a Highway Improvement Project”, with the Wisconsin Department of Transportation, for the improvement of West Appleton Avenue (USH 41) from West Capitol Drive (STH 190) to North 107th Street, with Federal and State aid, under the State Trunk Highway Improvement Program; with an estimated total cost of $9,353,500, which is a decrease of $1,246,500 and a total estimated City share of $699,700, which is an increase of $24,700.
Analysis
This resolution directs the Commissioner of Public Works to execute a revised project agreement with the Wisconsin Department of Transportation for the improvement of West Appleton Avenue (USH 41) from West Capitol Drive (STH 190) to North 107th Street. This project is approved and included in the Wisconsin Department of Transportation current State Trunk Highway Improvement Program. The City of Milwaukee is responsible for 0% of the preliminary engineering costs. City cost associated with Plan review and developments are 100% responsibility of the City of Milwaukee. City costs for the participating portion of construction for this project will be dependent upon the amount of parking allowed. The estimated total cost of this project is $9,353,500, of which the City’s share is $699,700 and the grantor’s share is $8,653,800.

Whereas, A project agreement has been executed by the Wisconsin Department of Transportation and the City of Milwaukee for the improvement of West Appleton Avenue (USH 41) from West Capitol Drive (STH 190) to North 107th Street., with Federal /State aid under the State Trunk Highway Improvement Program, in accordance with the Common Council resolution file number 061218 adopted February 6, 2007; and
Whereas, The Wisconsin Department of Transportation has approved shortening the westerly limits of the project, from USH 45 to North 107th Street; resulting in a decrease in estimated construction costs from the original agreement; and
Whereas, Additional work activities involving real estate acquisition, utility relocations, and traffic control, which are 100% Federal and/or State costs, and sidewalk repair and new sidewalk construction which are 100% and 20% the City of Milwaukee’s monetary responsibility respectively, were added, resulting in additional City costs to the original agreement; and
Whereas, A revised project agreement with the updated project costs has been received from the Wisconsin Department of Transportation, to be executed by the City of Milwaukee, under the State Trunk Highway Improvement Program; and
Whereas, Construction funds for the project will be included in a separate resolution; be it
Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works is hereby authorized to execute a revised project agreement for the improvement of West Appleton Avenue (USH 41) from West Capitol Drive (STH 190) to North 107th Street, under the State Trunk Highway Improvement Program; be it
Further Resolved, That the City Comptroller is hereby authorized to transfer to the appropriate accounts the amount required under the grant agreement and City Accounting Policy but not to exceed a 10% increase of the total amounts reserved for the grantor’s share and local share or $5,000, whichever is greater, as follows:
