Analysis

This resolution approves an additional appropriation of $15,000 from the Common Council Contingent Fund to the OutsideCounsel/Expert Witness Special Purpose Account for the purpose of providing outside counsel to the Employes' Retirement System/Annuity and Pension Board in Milwaukee Employes' Retirement System, et al. v. City of Milwaukee, Case No. 97-CV-000685.

BODY:

Whereas, The Employes' Retirement System/Annuity and Pension Board, are the plaintiffs in Milwaukee Employes' Retirement System, et al. v. City of Milwaukee, Case No. 97-CV-000685; and

Whereas, The Employes' Retirement System/Annuity and Pension Board have negotiated a contract with the firm of Whyte Hirschboeck Dudek, S.C. to provide them with representation in the above-referenced action; and

Whereas, FN 961465 adopted on 1/17/97 appropriated $15,000, and as of August, 1998, $9,823.22 had been expended and there is a remaining balance of only $5,176.78; now, therefore, be it

Resolved, That the sum of $15,000 be appropriated from the Common Council Contingent Fund (09-910-8000) to the Outside Counsel/Expert Witness Special Purpose Account (01-023-8001) and the City Attorney's Office Account (01-023-8002) for the purpose of providing outside counsel to the Employes' Retirement System/Annuity and Pension Board under the terms of the contract, at a rate of no more than $150.00 per hour, be and hereby is approved, such amounts to be expended upon the presentation and approval of invoices for service by the Office of the City Attorney.
