This substitute resolution will allow the City Treasurer's Office to proceed with foreclosure action at 1846 North Dr. Martin Luther King Jr. Drive and will also permit appropriation of funds for environmental remediation and convey ownership to the Redevelopment Authority of the City of Milwaukee.
BODY:
Whereas, It is in the best interest of the City of Milwaukee to perform environmental testing, remediation, acquisition and sale of tax delinquent properties which are known or suspected to be contaminated and which are marketable, eligible for reimbursement under the State of Wisconsin's Petroleum Environmental Cleanup Fund Act, and/or have high potential for elimination of hazards to public health or safety; and
 
Whereas, The property at 1846 North Dr. Martin Luther King Jr. Drive has been tax delinquent since 1990 and is known to be environmentally contaminated; and
 
Whereas, Common Council File No. 971406, adopted January 28, 1998, authorized the City Attorney's Office, the Department of City Development, and the Health Department to initiate actions preliminary to environmental testing of the property located at 1846 North Dr. Martin Luther King Jr. Drive and to proceed with phase II environmental assessment work; and
 
Whereas, Section 304-28.5 of the Milwaukee Code of Ordinances ("Code") provides for establishment of an Environmental Testing and Remediation Subfund within the Permanent Improvement Fund to be used for environmental testing and remediation of tax delinquent properties; and
 
Whereas, Section 304-28.5 of the Code further specifies that one of the funding sources for the Environmental Testing and Remediation Subfund is appropriations made by the Common Council, including both direct appropriations and borrowing authority; and
 
Whereas, The cost of environmental remediation for 1846 North Dr. Martin Luther King Jr. Drive is expected to be $10,500; and
 
Whereas, It is in the best interest of the City of Milwaukee to proceed with the acquisition of this property by the tax foreclosure process because of expressed redevelopment interest in addition to eliminating the blighting influence along with potential hazards to public health and safety; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee that the City Treasurer's Office is authorized and directed to proceed immediately with the tax foreclosure of 1846 North Dr. Martin Luther King Jr. Drive; and, be it
 
Further Resolved, That the Department of City Development, with technical advice from the Health Department and Department of Public Works, is authorized to expend up to $10,500 for remediation of 1846 North Dr. Martin Luther King Jr. Drive; and, be it
 
Further Resolved, That since this is in a Redevelopment Authority of the City of Milwaukee project area, the proper City officials are authorized and directed upon foreclosure, to transfer said ownership of said property, by Quit Claim Deed to the Redevelopment Authority of the City of Milwaukee.
