On April 29, 1997, the Utilities and Licenses Committee reviewed File Number 961491, a communication from the Alcohol Beverage Licensing Task Force transmitting the report of its recommendations to the Common Council. The license committee approved various recommendations contained in the Task Force report, with amendments to certain recommendations. This resolution approves those Task Force recommendations which were approved by the Utilities and Licenses Committee, amends or deletes certain of those recommendations, and directs the Legislative Reference Bureau to draft the appropriate legislation to implement those recommendations as approved in this file.
BODY:
Whereas, On July 30, 1996, the Common Council adopted File Number 960498, a resolution creating a 15-member Alcohol Beverage Licensing Task Force to conduct an in-depth examination of the policies, procedures and practices of the City of Milwaukee with respect to the granting of alcohol beverage licenses; and
Whereas, The Task Force held a total of 10 public meetings, beginning August 26, 1996, and submitted its final report and recommendations to the Common Council on January 31, 1997; and
Whereas, On April 29, 1997, the Utilities and Licenses Committee reviewed File Number 961491, a communication from the Alcohol Beverage Licensing Task Force transmitting the report of its recommendations to the Common Council; and
Whereas, The Utilities and Licenses Committee approved various recommendations contained in the Task Force report, with amendments to certain recommendations; and
Whereas, A complete list of the Task Force recommendations and the action taken by the Utilities and Licenses Committee on each recommendation is attached to this file; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the Common Council approves the following recommendations from the final report of the Alcohol Beverage Licensing Task Force, as amended and approved by the Utilities and Licenses Committee on April 29, 1997 (Note: Grouping and numbering of recommendations in this resolution is based on the arrangement of recommendations in the Task Force's report):
A. PUBLIC NOTIFICATION.
1. Public notice of all new applications or applications for renewal of alcohol beverage licenses should be published in the Milwaukee Journal Sentinel Newspaper. (The City of Milwaukee currently publishes such notices only in the Daily Reporter.)
2. Public notice of the upcoming license renewal for every alcohol beverage outlet should be affixed to the exterior of the licensed premise not less than 30 days prior to the renewal date. A forfeiture should be imposed upon the licensee for failure to post. Signage and posting requirements will be specified by the Utilities and Licenses Committee.
3. The results of aldermanic surveys should be sent to the License Division-City Clerk's Office to centralize information on licensing matters.
C. RESTRICT ACCESS TO SALE OF ALCOHOL BEVERAGES.
1. State legislation should be enacted to require 100% photo identification for all retail alcohol beverage purchases.
2. All convenience stores under 1,500 square feet should be required to maintain separate coolers and shelves for alcohol beverages, creating a vertical separation, to separate them from all other grocery items. Outlets in excess of 1,500 square feet should be required to have separate access and cashier facilities for alcohol beverage sales. For convenience stores under 1,500 square feet, products offered should be staple products as one enters a store, and alcohol beverages should be located toward the back of the store.
3. All individuals engaged in the sale of alcohol beverages (excepting persons licensed as managers, individual licensees and agents, and persons working at festivals) should be required to possess a valid bartender license. A resolution should be drafted to petition the state to change state law to allow municipalities to require all individuals engaged in the sale of alcohol beverages (excepting persons licensed as managers, licensees and agents, and persons working at festivals) to have a bartender's license.
4. State legislation should be enacted to allow the city to increase its penalties for underage sale of alcohol.
D. LICENSE CLASSIFICATION.
1. State legislation should be enacted to create classifications of alcohol beverages by alcohol content and to create classifications of alcohol beverage licenses accordingly.
2. State legislation should be enacted to create a separate alcohol beverage license classification (e.g., Class "B" Tavern/Restaurant) for bona fide restaurants doing not less than 50% of their retail business in food sales. Verification of the percentage of food sales should be based upon audit by a certified public accountant, at the request of the Utilities and Licenses Committee. It is further recommended that the Utilities and Licenses Committee should not include concentration of outlets as a factor when considering evidence relating to the granting of this particular type of license (tavern/restaurant), or a license to churches. In addition, both of these types of licensed premises should also not be included when evidencing concentration of outlets relating to granting of other types of alcohol beverage licenses.
G. LICENSE FEES.
State legislation should be enacted to enable the City to increase fees for alcohol beverage licenses.

Further Resolved, That the Legislative Reference Bureau is directed to draft the appropriate legislation to enable implementation of the recommendations approved in this file.
