Analysis

This ordinance increases various fees for permits, licenses, inspections and approvals, effective January 1, 2023.

Body

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

 

Part 1: Section 79-6.5-3-c-1 of the code is amended to read:

 

79-6.5. Special Collection Charges.

3. DOMESTIC TREE AND BULKY WASTE.

c-1. The commissioner may have bulky waste exceeding one cubic yard but not exceeding 6 cubic yards removed. The costs of this action shall be collected from the owner of the property at which the bulky waste is deposited, subject to the bulky collection charge established under s. 81-15.5. Bulky waste exceeding one cubic yard shall be tagged by the commissioner with a notice to the property owner to remove the waste within 3 days or be subject to the charge. The bulky waste collection charge shall be due and payable 30 days after billing. If any owner fails, omits, neglects or refuses to pay any charge imposed under s. 81- 15.5 for bulky waste collection, pursuant to s. 66.0627, Wis. Stats., the charge may be assessed against the subject property. The lien shall take effect as of the date of the delinquency. The lien shall automatically be extended upon the current or next tax roll as a delinquent tax against the property and all proceedings in relation to the collection, return and sale of the property for delinquent real estate taxes shall apply to such charge. The charge shall not be payable in installments. >>If any owner fails to notify the department that the bulky waste exceeding one cubic yard has been removed, resulting in a crew being dispatched to the property, the owner shall be charged a stop fee established under s. 81-15.5.<<

 

Part 2. Section 81-15.5 of the code is amended to read:

 

81-15.5. Bulky Waste Collection Charge.

1. [[$50]] >>$75<< for bulky waste in excess of one cubic yard, but not in excess of 4 cubic yards.

2. [[$150]] >>$225<< for bulky waste in excess of 4 cubic yards, but not in excess of 6 cubic yards.

 

Part 3. Section 81-15.5-3 of the code is created to read:

 

3. $35 stop fee for failure to notify the department as provided in s. 79-6.5-3-c-1.

 

Part 4. Section 81-50-5-c of the code is created to read:

 

81-50. Excavation Permit and Inspection Fees for Work in the Public Right of Way.

5. INSPECTION.

c. The fee for permits that need to be resubmitted, except permits issued to city forces, public utilities, or to persons engaged in work under a city contract for which inspectional services have been otherwise provided, shall be $100 for each resubmission.

 

Part 5. Section 81-51.5 of the code is amended to read:

 

81-51.5 Extra Garbage Cart Charge. The extra garbage cart charge shall be [[$18.04]] >>$18.76<< per quarter for each extra garbage cart provided under s. 79-4-1.3.

 

Part 6. Section 81-102-3-a-1 to 3, and b-1 to 3 of the code is amended to read:

e. Odd Structures. The fee for permanent odd structures, such as parking lots, reviewing stands and tank towers or additions thereto shall be computed at 1.4% of the cost of construction. The minimum fee shall be [[$68]] >>$100<<.

 

Part 16. Section 200-33-6-a and b of the code is amended to read:

 

6. CANOPIES.

a. The permit fee for hoods, canopies, and marquees projecting, and roofed sidewalks beyond a street line shall be computed at [[1.3%]] >>1.6%<< of the cost of construction.

Part 17. Section 200-33-8.5-a-1 and 2 of the code is amended to read:

 

8.5. CERTIFICATES OF OCCUPANCY.

a. Certificates of Occupancy.

a-1. The required fee for certificates of occupancy in existing buildings or parts thereof with gross areas of less than 10,000 square feet open lots, outdoor storage and outdoor circuses shall be [[$250]] >>$275<<.

e. Repair Permit Fees. The fees for installation or alteration permits required by s. SPS 302-15, Wis. Adm. Code, shall be charged at the rate of [[1.6%]] >>1.8%<< of the total cost of repair, with a minimum fee of [[$65]] >>$150<<.

 

Part 27. Section 200-33-16-a of the code is amended to read:

 

16. FIRE ESCAPE.

a. The permit fee for the erection of fire escapes shall be computed at [[1.3%]] >>1.6%<< of the cost of construction with a minimum fee of $65.

 

Part 28. Section 200-33-19-a of the code is amended to read:

 

19. FLAMMABLE LIQUIDS OR SOLIDS, VAULT OR ROOM.

a. The permit fee for the installation or alteration of vaults or rooms in any building for the storage or use of flammable solids, liquids or other combustible material shall be computed at the rate of [[1.3%]] >>1.6%<< of the cost or fraction thereof. The minimum fee shall be $65.

 

Part 29. Section 200-33-35-a-1 and 2 of the code is amended to read:

 

35. PLAN EXAMINATION, BUILDING, AUTOMATIC SPRINKLER, HEATING AND VENTILATING.

a. New Construction, Additions and Alterations.

a-1. Commercial Buildings, Structures and Parking Lots. The plan examination fees for new commercial buildings and structures, additions, alterations and parking lots shall be computed on the basis of square footage, in accordance with the following table. For new commercial buildings and structures, and for additions, square footage shall be calculated as defined in s. 200-08-86.2. For alterations, square footage shall be the square footage of the area to be altered. The plan examination fees for buildings and structures, additions and alterations involving hazardous occupancies shall be double the fees specified in the table.

Part 32. Section 200-33-42.5 of the code is amended to read:

 

42.5. PLUMBER OR PLUMBING BUSINESS REGISTRATION. The fee for registration of a master plumber or plumbing business pursuant to s. 225-2 shall be [[$60]] >>$75<<. This fee shall be paid at the time the applicant files the required performance and indemnity bonds.

 

Part 33. Section 200-33-43-a to d of the code is amended to read:

 

43. PLUMBING.

Part 34. Section 200-33-43-f to j of the code is amended to read:

 

f. Inspection or reinspection for installation of a well or well pump: [[$60]] >>$85<< each.

g. Abandonment of Sewer and Water Lateral, Well, Septic System or Holding Tank.

g-1. Inspection or reinspection for abandonment of each sewer and water lateral: $30 if within the city limits or $45 if outside the city limits, with minimum fees of [[$60]] >>$75<< within the city limits and $85 outside the city limits.

Part 35. Section 200-33-43-m and n of the code is amended to read:

 

m. For the issuance of a 5-year well operation permit: [[$90]] >>$100<<.

Part 36. Section 200-33-48-a of the code is amended to read:

 

48. REINSPECTION FEE.

a. To compensate for inspectional and administrative costs, a fee of [[$175]] >>$200<< may be charged for any reinspection to determine compliance with an order to correct conditions of provisions of the code under the jurisdiction of the department of neighborhood services or assigned to the department, except no fee shall be charged for the reinspection when compliance is recorded. A fee of [[$350]] >>$400<< may be charged for each subsequent reinspection. Reinspection fees shall be charged against the real estate upon which the reinspections were made, shall upon delinquency be a lien upon the real estate and shall be assessed and collected as a special charge for payment and settlement as provided in ch. 19 of the city charter.

 

Part 37. Section 200-33-52-a-1 to 6-c of the code is amended to read:

 

52. SPRINKLER, STANDPIPE AND SUPPRESSION SYSTEMS.
