Title
Resolution authorizing the Commissioner of Public Works to issue one or more permits to the Milwaukee Symphony Orchestra League (MSOL) allowing the MSOL to install and maintain "Beastie" sculptures in the public right-of-way at various locations in the City during the summer of 2004.
Analysis
The Milwaukee Symphony Orchestra League is conducting a fund raising campaign in which contributors become sponsors of Beastie sculptures.  The sculptures will be publicly displayed during the summer of 2004.  Each sculpture will be artistically customized. It is expected that 50 - 60 individual sculptures will be sponsored through the fund raising campaign.  Most of the Beasties will be located in the downtown area.  And most of those will be placed on property under control of the City of Milwaukee, generally public sidewalks.  This resolution authorizes the Commissioner of Public Works to issue a permit to the Milwaukee Symphony Orchestra League allowing it to install the Beasties while obligating the Milwaukee Symphony Orchestra League to maintain them and to remove them, if necessary, during the permit period and upon expiration of the permit.
 
The Milwaukee Symphony Orchestra League's 2004 Beastie program replicates a similar program the MSOL undertook in the summer of 2002.  At that time, the City participated in the same way envisioned by this resolution.
Body
Whereas, The MSOL is conducting a fund raising campaign that involves sponsorship of Beastie sculptures by contributors; and
 
Whereas, These sculptures will be artistically customized and then publicly displayed between May 28th and September 6th of this year; and
 
Whereas, Between 50 and 60 Beastie sponsorships are expected; and
 
Whereas, While the exact location where each of the Beasties will be displayed is not yet known, most will be located within the City of Milwaukee and most of these will be sited downtown; and
 
Whereas, Almost all the Beasties to be located in the City will be installed in public sidewalk areas under the jurisdiction of the Department of Public Works; and
 
Whereas, The MSOL will be responsible for (1) installation of the Beasties, (2) any and all maintenance of the Beasties that may be required while they are on display, (3) temporary relocation of the Beasties as may be necessary to accommodate short term events, and (4) removal of the Beasties upon conclusion of the program; and
 
Whereas, A permit from the Commissioner of Public Works is required to allow installation of the Beasties in City rights-of-way or on other City property under the jurisdiction of the Department of Public Works; and
 
Whereas, The MSOL ran a similar Beastie fund raising program in the summer of 2002; and
 
Whereas, City permitting for that earlier program was handled in the same manner planned for the 2004 program; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works is hereby granted authority to issue a permit to the Milwaukee Symphony Orchestra League for the purpose of installing, maintaining and removing Beastie sculptures in City rights-of-way and on other City property under the jurisdiction of the Department of Public Works; and, be it
 
Further Resolved, That the Commissioner shall incorporate in the permit reasonable terms and conditions to ensure that the spirit and intent of this resolution is achieved and to ensure that the City of Milwaukee is held harmless for any potential liability associated with placement of the Beasties in City rights-of-way or on other City property.
