Substitute resolution to authorize acceptance and expenditure of a Hazard Mitigation Grant from the Federal Emergency Management Agency and to authorize acceptance and expenditure of Housing and Urban Development funds allocated to the City of Milwaukee by Milwaukee County.

- ANALYSIS -
This resolution allows the Commissioner of Public Works to accept Hazard Mitigation Grant funds from the Federal Emergency Management Agency (FEMA) and to accept Housing and Urban Development (HUD) funds from Milwaukee County. Both FEMA and HUD funds will be used for the acquisition, relocation and demolition of substantially damaged properties in the Lincoln Creek area and for flood proofing homes in the Menomonee Valley area. The FEMA funds will support 87.5% of the costs for both acquisition and flood proofing projects and the HUD funds will provide the 12.5% local share of both projects.
 
BODY:
Whereas, Southeastern Wisconsin Counties experienced flooding on June 21, 1997 due to severe storms; and
 
Whereas, A Presidential Disaster Declaration was declared, which made funding available for mitigation activities through the Hazard Mitigation Grant Program and as authorized by Resolution 971325 the Commissioner of Public Works submitted a formal application for flood hazard mitigation funds to the Federal Emergency Management Agency (FEMA) on January 8, 1998; and
 
Whereas, The original grant application for $1,500,000 was for flood proofing homes in the Lincoln Creek ($1,255,600) and Menomonee Valley ($244,400) areas of the City of Milwaukee; and
 
Whereas, After experiencing another flood event on August 6, 1998 an amendment to the original application was submitted to FEMA on September 25, 1998 requesting the funds for the Lincoln Creek area be used for the acquisition, relocation and demolition of substantially damaged properties; and
 
Whereas, The Department of Building Inspection has identified 19 residential properties in the Lincoln Creek area as being substantially damaged as defined in Section 295-7-176 of the Milwaukee Code of Ordinances; and
 
Whereas, The grant application has now been approved by FEMA in the amount of $1,613,000 (as detailed below),

with the additional funding over and above the amount applied for designated for the acquisition of substantially damaged properties in the Lincoln Creek area; and
 
Whereas, The FEMA grant also allocates $27,130 in administrative allowance; and
 
Whereas, Milwaukee County has by resolution File No. 98-657 allocated funds which it received from Housing and Urban Development (HUD) to the City of Milwaukee in the amount of $320,000 ($47,500 to the Valley Park neighborhood and $272,500 to the Lincoln Creek Neighborhood) to be used for the local share of flood proofing in the Valley Park area and to be used to supplement the City of Milwaukee's flood proofing and mitigation efforts in the Lincoln Creek Neighborhood; and
 
Whereas, The City of Milwaukee also received funding directly from HUD for disaster relief due to the severe flooding in June of 1997 and by Resolution 980234 a grant program was established to administer and expend these funds in the Neighborhood Improvement Development Corporation (NIDC); and
 
Whereas, It would be in the best interests of the City of Milwaukee to administer and expend the funds for flood proofing in the Menomonee Valley area from the FEMA grant through the program already established in the NIDC by Resolution 980234; and
 
Whereas, The FEMA funding for the acquisition of substantially damaged properties in the Lincoln Creek area would be administered by the Department of Public Works, with the Department of City Development performing the duties involved in the acquisition of these properties and the relocation of the occupants; and
 
Whereas, The operation of this 1997 Hazard Mitigation Grant would cost $1,758,505 of which 100% would be provided by the grantors as follows:

; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works is hereby authorized to accept from the Federal Emergency Management Agency the Hazard Mitigation Grant funds, designated to provide flood proofing in the Menomonee Valley and to provide for the acquisition of substantially damaged properties in the Lincoln Creek area; and, be it
 
Further Resolved, That the Commissioner of Public Works is hereby authorized to accept from Milwaukee County, the Housing and Urban Development funds allocated to the City of Milwaukee to be used for the local share of flood proofing in the Menomonee Valley area and to be used to supplement the City of Milwaukee's flood proofing and mitigation efforts in the Lincoln Creek area; and, be it
 
Further Resolved, That the $213,850 provided by the FEMA Hazard Mitigation Grant for flood proofing in the Menomonee Valley and the $47,500 from Milwaukee County designated to provide the local share of the flood proofing in the Menomonee Valley be forwarded to NIDC to be used in conjunction with the HUD funded grant program established by Resolution 980234; and, be it
 
Further Resolved, That the $27,130 allocated in conjunction with the FEMA Hazard Mitigation Grant for administrative allowance, also be forwarded to NIDC for the administration of the flood proofing in the Menomonee Valley; and, be it
 
Further Resolved, That the NIDC is authorized to expend the FEMA funding provided under this resolution only for the flood proofing of the properties established in the original application to FEMA dated January 8, 1998 or on properties subsequently approved by FEMA and shall not use the allocation from Milwaukee County provided under this resolution for the local share, for any properties other than those approved by FEMA until the FEMA funding provided to NIDC is exhausted; and, be it
 
Further Resolved, That the Department of Public Works is authorized to expend the remaining FEMA Hazard Mitigation Grant funding ($1,197,525) and Milwaukee County allocation ($272,500) for the acquisition, relocation and demolition of residential properties in the Lincoln Creek area; and, be it
 
Further Resolved, That the Common Council of the City of Milwaukee authorizes the acquisition of up to 19 residential properties; to raze or relocate the improvements and retain the land in inventory; and, be it
 
Further Resolved, That the Department of City Development is authorized and directed to file a relocation plan, for the relocation of the occupants of said properties to be acquired by the City, to the State of Wisconsin Department of Commerce in accordance with Section 32.25 of the Wisconsin Statutes; and, be it
 
Further Resolved, That the Commissioner of the Department of City Development or his designee, is authorized and directed to do whatever is necessary to expedite the acquisition of said properties, the relocation of the occupants of said properties and to execute documents which may be required in performing these functions, all in accordance with the Guidelines and Procedures for Acquisition Programs under the Hazard Mitigation Grant Program of the Wisconsin Division of Emergency Management; and, be it
 
Further Resolved, That the City Comptroller is authorized to:
 
1. Encumber in the parent accounts of the 1998 Special Revenue Accounts-Grant and Aid Projects, the following amounts for the program/project titled 1997 Hazard Mitigation Grant

Further Resolved, That these funds are appropriated to the Department of Public Works which is authorized to:
 
1. Expend from the amount appropriated sums for specified purposes as indicated in the grant budget and incur costs consistent with the award date;
 
2. Enter into contracts as may be required.
