Resolution approving a lease amendment with the Board of Business Improvement District No. 2 for the Erie Street Plaza, in the 4th Aldermanic District.
Analysis
This resolution authorizes a lease amendment for a City pedestrian mall according to the conditions outlined in the Lease Amendment.
Body
Whereas, By passage of Resolution File No. 100114 in 2010, the Common Council of the City of Milwaukee authorized and directed the Departments of Public Works (“DPW”) and City Development (“DCD”) to commence lease negotiations with the Business Improvement District (“BID”) No. 2 for Erie Street Plaza at the south end of East Erie Street and adjacent to the Milwaukee Harbor entrance; and
Whereas, Staff from DPW, DCD and the City Attorney’s Office met with representatives of BID No. 2 and negotiated the terms of a long-term lease for the Erie Street Plaza; and
Whereas, By passage of Resolution File No. 100263, the Common Council of the City of Milwaukee approved a lease with the Board of Business Improvement District No. 2 for the Erie Street Plaza; and
Whereas, The lease with BID No. 2 permits the BID to program activities in the plaza in consideration of it assuming maintenance responsibilities of the plaza; and
Whereas, The lease facilitates use of and activities in the plaza, ensures public access and establishes maintenance requirements while helping to reduce municipal expenditures; and
Whereas, The 15-year lease term expired on June 30, 2025, and the BID and City desire to amend the lease to extend the term to June 30, 2040, a copy of which is attached to this Common Council File; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the lease amendment with the Board of BID No. 2 for the Erie Street Plaza is approved; and, be it
Further Resolved, That the Commissioner of DCD, or designee, is authorized to execute the lease amendment with the Board of BID No. 2 and any other necessary documents upon final approval of the lease by the Common Council; and, be it
Further Resolved, That the City Attorney’s Office, in cooperation with the Commissioners of DPW and DCD, is authorized to make such further minor modifications to said lease amendment that are consistent with the intent and purpose of this resolution and which are mutually acceptable to the City Attorney and the Commissioner of DPW and DCD.
