Title
Resolution authorizing the Commissioner of Public Works to execute a Utility Agreement Change Order with the Wisconsin Department of Transportation for engineering and construction inspection work on the Greywolf private main sanitary sewer in conjunction with the Zoo Interchange's 76th Street Bridge over I-94.
Analysis
This resolution approves the entitled Change Order for payment for engineering review and construction inspection for the relocation or replacement of Greywolf private main sanitary sewer facilities located on privately held land required by freeway construction, and authorizes the Commissioner of Public Works to execute the Change Order on behalf of the City of Milwaukee.
This Change Order relates to utility work on Greywolf private main sanitary sewer necessitated by the rehabilitation of the Zoo Interchange's South 76th Street Bridge over I-94, contract work State Project ID 1060-33-00/78, contract being undertaken by the Wisconsin Department of Transportation in 2013. This Change Order provides generally for the City to be reimbursed from the State 100 percent of the City costs for all work on Greywolf private main sanitary sewer necessitated by the freeway rehabilitation project in accord with Wisconsin State Statue 84.295(4m).
Body
Whereas, The State of Wisconsin Department of Transportation has scheduled the reconstruction of the Zoo Interchange in the City of Milwaukee, Milwaukee County; and
Whereas, There will be work required on Greywolf private main sanitary sewer as a result of the Zoo Interchange's South 76th Street Bridge over I-94 contract, contract work State Project ID 1060-33-00/78; and
Whereas, The City of Milwaukee will be required to do engineering and inspection work on the Greywolf private main in order to facilitate the necessary modifications to the facility; and
Whereas, Wisconsin State Statue 84.295(4m) indicates that the Wisconsin Department of Transportation will pay 100 percent of the cost of alteration, rehabilitation, and relocation of private main sanitary sewer with the responsible jurisdiction liable for zero percent of the cost; and
Whereas, The City of Milwaukee received authority to enter in to a Municipal Audit Agreement Number (521), with the Wisconsin Department of Transportation (Res. No. 130027), through which the Wisconsin Department of Transportation initially indicated reimbursement would be granted; and
Whereas, The Wisconsin Department of Transportation has rendered said Audit Agreement null and void due to unforeseen logistical difficulties; and
Whereas, The Wisconsin Department of Transportation has instead requested the execution of a Utility Agreement Change Order, to the City's already-legislated Utility Agreement No. 642 (Resolution No. 130032) (Utility Project ID 1060-43-48), be undertaken and used as the vehicle through which the City of Milwaukee can be reimbursed for their costs associated with the Greywolf private main sanitary sewer; and
Whereas, Resolution No. 130027 has already authorized the Commissioner of Public Works to prepare and review plans and estimates as necessary to accomplish the project and City Comptroller to establish the necessary internal accounts (ST320125245) to track the work associated with the Greywolf private main sanitary sewer, undertaken by City forces, for a total amount of $12,000 with a City share of $0.00;
Whereas, Resolution No. 130027 has already authorized the Commissioner of Public Works to make periodic payments and invoices as necessary to accommodate the work required for the Zoo Interchange freeway work utility alterations as required under the aforementioned Change Order; therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works is hereby authorized to execute the Utility Agreement Change Order for the City engineering and construction inspection work associated with the Greywolf private main sanitary sewer, attached to this resolution by reference as though set forth in full.
