Substitute Resolution relative to continuation of 1994 and 1995 HOME funding from the U.S. Department of Housing and Urban Development through the Community Block Grant Administration (CBGA).
ANLS:
Resolution authorizing the continuation of the use of HOME Program Grant funds generated from program income from prior years. (Community Development Block Grant)
BODY:
Whereas, The City of Milwaukee was first awarded funds from the U.S. Department of Housing and Urban Development (HUD) through the HOME Program (M92-MC550204) on February 21, 1992; and
 
Whereas, Common Council Resolution file Number 931069 adopted November 11, 1993 authorized acceptance and funding for the HOME Program for 1994; and
 
Whereas, Common Council Resolution file number 940981 and 941953 adopted November 7, 1994 and April 25, 1995 respectively, authorized acceptance and funding for the HOME Program for 1995; and
 
Whereas, The Common Council Resolution File Number 940843, (Grant Resolution) adopted October 18, 1994 states "The carrying over of unexpended funds shall be limited to 3 years from the year in which the funds were appropriated, or as provided by law"; and
 
Whereas, Funds distributed from the allocation will be repaid from time to time and returned to the city for reuse in accordance with the program description approved by HUD; and
 
Whereas, It has been determined that the benefits to the City from this HOME program activity appear to exceed the City's share of costs and other obligations to be incurred under this program; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the Community Block Grant Administration is hereby authorized to continue operation of the HOME Program activity using unspent and or program income funds from the above referenced 1994 and 1995 fiscal years; and be it
 
Further Resolved, That the proper City officials and/or herein named department head are authorized to continue the HOME Program activity without further Common Council approval; and be it
 
Further Resolved, That the Block Grant Director is hereby authorized to expend, from the amounts appropriated, sums for specified purposes in accordance with the previously approved ongoing budget for the project in accordance with City Procedures and Grant Guidelines; and, be it
 
Further Resolved, That except as modified by this resolution, the guidelines for handling the HOME Grant Program shall be consistent with the CDBG Program as set forth in Common Council File Number 74-92-5v and is fully applicable to the HOME Program; and, be it
 
Further Resolved, The Block Grant Director shall have the authority to continue transfers within the aforementioned project budget as long as the amounts expended are in accordance with Grantor Regulations.
