ANLS:
- ANALYSIS - This resolution approves an Out-of-Program Agreement between the City of Milwaukee and Arlington Investments, Wisconsin VII LP. Arlington Investments proposes to construct a multifamily residential project at 6101 West Bradley Road. Zoning for the project was approved by the Common Council on January 20, 1998. The Out-of-Program Agreement provides for the design and construction of a public water main to serve the project. All costs associated with the water main would be paid by the developer.
BODY:
Whereas, The City of Milwaukee has recently approved Common Council File Number 97118 being an ordinance to change the zoning of property located at 6101 West Bradley Road to allow construction of a multifamily residential apartment complex; and
Whereas, The developer, Arlington Investments, Wisconsin VII LP, now wishes to enter into an Out-of-Program Agreement with the City of Milwaukee for the construction of public water main in easement through the development site to serve the project; and
Whereas, Under the terms of the agreement, all costs associated with design and construction of the water main will be assumed by the developer; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that the Out-of-Program Agreement attached to this resolution as Exhibit "A" is hereby approved and the appropriate City Officials are hereby authorized to sign it on behalf of the City; and, be it
Further Resolved, That the Commissioner of Public Works is authorized to make minor, non-substantive changes to the Out-of-Program prior to its execution, and, be it
Further Resolved, That any funds deposited by the developer with the Department of Public Works prior to the date of this resolution are authorized to be used for design engineering.
