Resolution approving a Maintenance Agreement between Tandem Developers LLC and the City of Milwaukee.
ANALYSIS
Tandem Developers LLC is the developer of the Brewer's Hill Commons residential project in the Brewer's Hill neighborhood. As part of that development, traffic circles were installed at the intersection of North Hubbard and East Brown Streets and at the intersection of North Hubbard and East Reservoir Streets. This resolution approves a Maintenance Agreement between the City and Tandem Developers whereby Tandem and its successors commit to maintain the landscaping in the two traffic circles.
BODY
Whereas, Tandem Developers LLC is developing a residential project in the Brewer's Hill neighborhood known as Brewer's Hill Commons; and
Whereas, As part of that development, traffic circles were installed at the intersection of North Hubbard and East Brown Streets and at the intersection of North Hubbard and East Reservoir Streets; and
Whereas, These traffic circles include landscaping that will require maintenance over time; and
Whereas, The developer has agreed to be initially responsible for the required landscape maintenance; and
Whereas, The developer has further agreed to assign the landscape maintenance obligations to the two condominium associations that will ultimately take over common area maintenance for Brewer's Hill Commons; and
Whereas, A Maintenance Agreement outlining the developer's and, subsequently, the condominium associations' maintenance responsibilities for the traffic circles has been prepared and is attached to this file; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the Maintenance Agreement between Tandem Developers LLC and the City of Milwaukee attached to this file is hereby approved; and, be it
Further Resolved, That the appropriate City officials are hereby authorized to execute the agreement on behalf of the City; and, be it
Further Resolved, That the Commissioner of Public Works is authorized to make minor, non-substantive changes to the Maintenance Agreement prior to its execution.
