This resolution directs the DOA - Intergovernmental Relations Division to seek introduction and passage of state legislation relating to procedures to suspend motor vehicle registrations, to authorize the City of Milwaukee to suspend vehicle registrations for non-payment of parking citations by directly accessing WISDOT's vehicle registration database. This resolution further directs that upon enactment of such legislation, any implementation of the registration suspension process by appropriate City entities shall require Common Council approval.
BODY:
Whereas, The City of Milwaukee's current process for collection of outstanding parking citations includes sending the registered owner of a vehicle notices of outstanding parking citations 10 days and 28 days after issuance of a citation; and
Whereas, After 58 days, if no payment has been made, the City applies to the State of Wisconsin Department of Transportation, Division of Motor Vehicles (WISDOT), to suspend the vehicle's registration, and WISDOT subsequently sends a notice of suspension to the registered owner indicating that the parking citation must be paid in order for the suspension to be lifted; and
Whereas, There are sometimes long delays between the time the City requests the suspension and when the suspension is issued by WISDOT; and
Whereas, WISDOT charges the City $5 for each vehicle suspension, and in the case of multiple citations, the City's practice has been to suspend only the oldest citation, with some vehicle owners then paying the oldest citation and having the suspension lifted before the City can apply for a registration hold based on the next oldest citation; and
Whereas, WISDOT has invested in new technology which would make it possible for the City to directly access state motor vehicle registration information, and the City's contractor for citation processing has expressed an interest in the prospect of the City directly entering registration suspension information into WISDOT's database; and
Whereas, WISDOT has expressed interest in the possibility of giving the City authority to directly suspend vehicle registrations for parking citations, but a change in state law is necessary for the City to assume this responsibility; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the Department of Administration - Intergovernmental Relations Division (IRD) is directed to seek introduction and passage of state legislation relating to procedures to suspend motor vehicle registrations, to authorize the City of Milwaukee to suspend motor vehicle registrations for non-payment of parking citations by directly accessing WISDOT's vehicle registration database; and, be it
Further Resolved, That upon enactment of this legislation, any implementation of the registration suspension process by the Department of Public Works and other appropriate City entities shall require Common Council approval.
