Analysis
This ordinance requires owners of commercial and multi-family residential properties to ensure the lids of solid waste containers on their properties are kept closed.
Body
Whereas, Many business owners and residential property managers are unable to close the lids of dumpsters overflowing with garbage due to the amount of trash produced on their premises; and
Whereas, The overflow of litter due to limited dumpster space creates an eyesore for nearby residents, and can lead to health and environmental problems, such as rat and bug infestations; and
Whereas, Owners of commercial and multi-family residential properties with overflowing dumpsters that are subject to fines would be incentivized to seek additional dumpsters for their premises or to increase the frequency of trash collection from their dumpsters; now, therefore
The Mayor and Common Council of the City of Milwaukee do ordain as follows:
Part 1. Section 79-3-4-a-3 of the code is created to read:
79-3. Waste Containers Required.
4. FOR COMMERCIAL AREAS.
a-3. Receptacle Lids to be Closed. The owners or operators of shopping centers, commercial or business establishments are to ensure that the lids of solid waste containers are kept closed and that garbage remains inside the containers and does not overflow the containers. A property owner who permits a quantity of garbage on their property that exceeds the space available in their waste container or containers shall acquire additional receptacles or increase the frequency of garbage collection, or shall be subject to the penalties of s. 79-16.
Part 2. Section 79-4-2.5 of the code is created to read:
79-4. Waste Container Regulations.
2.5 NONPORTABLE CONTAINERS; CLOSURE OF LIDS.
The owner of a multi-family residential property shall ensure that the lids of waste containers are kept closed and that garbage remains inside the receptacle and does not overflow the containers. A property owner who permits a quantity of garbage on their property that exceeds the space available in their waste container or containers shall acquire additional receptacles or increase the frequency of garbage collection, or shall be subject to the penalties of s. 79-16.
