This resolution approves guidelines regarding the location, design and operation of sidewalk area dining facilities (i.e. outdoor cafes). These guidelines are referenced in section 115-32.6 of the Milwaukee Code. This section authorizes the Commissioner of Public Works to issue permits for sidewalk area dining facilities with the concurrence of the local Common Council member . Previously these were only allowed upon approval by the Common Council of a special privilege.
BODY:
Whereas, The City of Milwaukee already has a number of outdoor cafes located in public sidewalk areas; and
Whereas, These outdoor cafes add vitality, character and interest to urban life; and
Whereas, The City wishes to encourage more of such outdoor cafes and, to do so, has modified its permitting rules to simplify and expedite the approval process; and
Whereas, The new outdoor cafe (entitled Sidewalk Area Dining) permit process is outlined in Section 115-32.6 of the Milwaukee Code; and
Whereas, Section 115-32.6-6 references outdoor cafe guidelines to be reviewed and approved by the Common Council; and
Whereas, These guidelines are to address the location, design and operation of outdoor cafes and are to be used by the Commissioner in evaluating proposals therefor; and
Whereas, The proposed guidelines are attached to this file as Exhibit "A"; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the Sidewalk Area Dining Guidelines attached to this file as Exhibit "A" are approved; and, be it
Further Resolved, That the Commissioner of Public Works is authorized and directed to use these guidelines in evaluating and permitting applications for sidewalk dining area permits.
